A serving RAF soldier arrested in Mallorca after a British holidaymaker accused him of raping her at a four-star hotel in Magaluf has been released and allowed to leave the island.
The 27-year-old was told he remains under investigation over the alleged sexual assault in Magaluf and must respond to any future court summons.
But he got his passport back last night after being dragged before a judge in handcuffs following a night in a police cell – and was told he could fly back to Britain after his female accuser failed to dismiss her initial complaint in the court to confirm.
He now faces several weeks and possibly months of uncertainty as he waits to see whether the case against him is dismissed and the investigating judge tries to determine whether the woman who accused him of forcing himself on her will make a new statement under oath.

News of the soldier’s arrest emerged yesterday, shortly before he was pictured arriving at the court in the Mallorcan capital Palma wearing the same clothes he wore when he was arrested at the island’s airport on Monday, just before he boarded a flight back to Britain.
His female accuser, who is said to have returned to Britain yesterday, told police he forced himself on her at a hotel in Magaluf where she was staying after meeting her at a bar in the party resort a few hours earlier and spending time with had spent on her. on the beach.
The alleged sex attack is said to have taken place around 5 a.m. on Monday on a terrace at the hotel, which we are not naming to protect the identity of the 21-year-old woman who reported him to police.
She told investigators that her aggressor ripped her dress and forced her to perform a sex act on him before raping her.
Civil Guard officers are said to have discovered the suspect’s identity hours after she filed a formal complaint.

Another said: ‘He was on holiday in Mallorca with a group of rugby players who had come to the island to take part in an event.
‘He was arrested shortly before boarding his flight back to Britain.’
The Briton’s lawyer is now expected to submit a formal request to dismiss the case.
No formal charges have yet been laid and a prosecution would be unlikely if the female holidaymaker at the center of the case decides not to press charges.
