Charlie Sheen to get full custody of his twin sons, 14, if ex Brooke Mueller fails drug test following her 2023 relapse – one month after claiming he is a ‘single dad’ to boys

Charlie Sheen will reportedly receive full custody of his twin sons, Bob and Max, in the event that his ex-wife, Brooke Mueller, “tests positive for drugs or alcohol.”

On Thursday, the Two and a Half Men actor was granted an emergency motion stating that he would “immediately” assume “sole legal custody” of their 14-year-old boys if she failed a drug test.

The order reads: “Brooke will test for drugs and alcohol (1) as often as required by her probation officer, (2) within 24 hours of a written request (email or text message) from Charlie or his attorney, and (3) at least once a week anyway.”

The documents also explicitly state that Mueller’s “custody/visit will terminate immediately upon any positive test,” and that any “missed test will be considered a positive test.” ,

The actor’s former husband, who he divorced in 2011 after three years of marriage, will also have to provide Sheen’s lawyer with the “names, addresses and telephone numbers of all her regular, historical sources of controlled substances.”

This comes just a month after he claimed he is a “single dad” to his boys and that their mother is “not in the picture too much at the moment.”

Sheen, 58, who recently celebrated six years of sobriety, welcomed Bob and Max with Mueller, 46, in 2009 during their turbulent three-year marriage from 2008-2011.

He told People: ‘I mainly raised my 14 year old boys. Their mom has been trying to figure some things out on her end, so she’s not in the picture much at the moment.

Sheen and Mueller only recently resolved their years-long child support case after Charlie filed a request to pay less to his children in 2018.

They had a difficult relationship as they both had well-documented struggles with addiction.

Charlie also pleaded guilty to assault over a domestic dispute between the couple in December 2009.

Brooke claimed to police that the actor held a knife to her throat and threatened her, but she later tried to retract her statement.

A protective order was issued and Charlie pleaded guilty to a lesser charge that would keep him out of jail.

AP reported at the time that Charlie was sentenced to 30 days of drug rehabilitation, 30 days of probation and 36 hours of anger management.

A year later the couple separated. Months later, the actor was involved in a series of now infamous public meltdowns in early 2011 that led to him being fired from the hit sitcom Two And A Half Men.

The former couple came to a custody agreement in 2011 and finalized their divorce shortly after.

But Brooke is said to have created an ‘unsafe’ environment for the twins and they were removed from her home in 2013.

Charlie’s ex-wife Denise Richards became their legal guardian while Brooke went back to rehab for the 21st time.

But after a year, the Wild Things star wrote a letter to the Los Angeles County Department of Children and Family Services (DCFS) informing them that she could no longer care for the boys due to their alleged violent outbursts against her daughters and dogs. TMZ.
