A Canadian man who walked out of his bathroom naked and found police officers in his bedroom trying to charge him with a traffic violation has filed a lawsuit alleging abuse of power.

Kirk Forbes claims Royal Canadian Mounted Police officers abused their authority when they entered his home in Coquitlam, British Columbia, last June.

Forbes said the officers had tried to give him a traffic ticket for passing a stopped school bus seven months earlier.

He claims that after arriving at his home, they knocked on the front door, which then swung open, prompting them to enter the property.

Forbes said a female officer entered his bedroom to find him, while a male officer remained in his living room.

“When I open the bathroom door and bang, I’m face to face with an intruder in my home,” he said CTV.

‘There was a bit of panic. Luckily I did see the uniform. There’s such a gross overreach – abuse of power – that I think happened when they came into my house.

“I think Canadians should be aware of it. It’s an erosion of not just my rights, but everyone’s rights.”

Forbes went to file a complaint with his local RCMP station, after which he claims the receptionist called him “the shower guy.”

“It was quite concerning, not to mention embarrassing, to know that this situation has become a water jug ​​chatter in the RCMP hall.

“If I get pulled over or see an RCMP in the community, should I look at them and let them know that guy is me?”

The lawsuit alleges that the two unnamed officers “abused their authority and power” when they entered his home without permission.

Forbes also claims in the lawsuit that the officers failed to announce their presence and “almost attempted to neutralize the intruder by tackling them” after leaving the shower.

According to CTV, Forbes has filed a lawsuit against the two officers, Canada’s attorney general and B.C.’s minister of public safety.

Coquitlam RCMP said in a statement: “The Coquitlam RCMP is aware of the notice of civil claim and is aware of the ongoing legal proceedings.

“In June 2022, a member of the Coquitlam RCMP attended a residence to serve a trespass notice when they encountered an apparently insecure property.

‘Eventually our officers were able to make contact with the resident, who expressed concerns about his presence.

“We thought we had dealt with these concerns informally, but the resident has filed a formal public complaint that is currently ongoing.”

Coquitlam RCMP said the case remains under investigation.

“This investigation will include a thorough review of the entirety of the available documentation, including radio broadcasts and other related materials, as well as the previous informal process undertaken to address any concerns,” their statement added.

“As with any civil claim against the RCMP, the Department of Justice will review the claim and prepare a statement of defense for the RCMP, which will then be issued through the courts.

“It would be inappropriate for us to comment further at this time.”

Forbes also told the newspaper that he was disputing the ticket officials who gave him that day and that legal proceedings were also underway.
