Australian farmer Wayne Green, 53, is found guilty of raping British backpacker as court hears how he forced her into sex act while she was drunk – and knew she couldn’t say no as she needed a visa

A farmer has been jailed for more than three years for raping a British backpacker who worked on his land as part of her visa.

Wayne Robert Green was found guilty of rape and obtaining a sexual act by intimidation on Thursday after a three-day trial in Queensland’s Kingaroy District Court. He was found not guilty of assault.

The 53-year-old denied the allegations.

The father-of-three was aware his victim had no money and wanted to stay in Australia on her visa, Judge Glen Cash said. South Burnett Times reported.

“You abused that position,” Judge Cash said.

‘There was no real consent from her. It has caused her relationship problems and fear of men.’

The court heard how Green raped the woman while she worked on his farm in Mondure for two weeks as part of her working holiday visa.

She had to work on the farm for 88 days to extend her visa and found Green’s job advert on Gumtree.

Female accuser Christa Nicola had previously told the court how the woman came home from the pub one night and Green would ‘pay her’ for oral sex.

“She was afraid he would rape her if she didn’t comply,” Nicola said, adding that the woman had only $4 to her name at the time.

The man was naked at the time and the victim was drunk.

‘She felt like she had no choice. He put her on the sofa, she was naked, he was naked, he touched himself… at one point she had his penis in his mouth,” Ms Nicola said.

‘He said the words “suck my c*** you w***” and he was aggressive and pushed her head down.’

In another incident, Green allegedly touched the woman’s breasts without her consent while she was in a truck with Green and a male farm worker.

But the other man told the court he did not see Green touch her breasts during the trip.

“There was a moment where we were all drunk and she was all flashing cars with her breasts,” the witness said. “I was flirting with her, maybe I touched her breasts.”

He also said that he may have “sucked her breast” during the trip, that he was friends with the woman and had slept with her a few times.

The man said the backpacker told him about performing oral sex on Green, but he “didn’t really ask any questions about it.”

However, three other witnesses told the court that the British woman told them she had been sexually abused by Green, with one saying it was ‘the worst time of her life’.

Two witnesses said the victim said Green had a “no doors policy” in the home, walked around naked and sometimes went to the bathroom while she was showering.

This made her uncomfortable and afraid to be there alone with him, a witness said.
