A baby rapist who repeatedly filmed himself sexually assaulting a two-year-old girl will have a cellmate testify in support of his claim that he needs special prison privileges.

Jason Daron Mizner – whose vile crimes in two countries include muzzle a toddler to stop her screaming – is currently facing a tribunal for discrimination related to his treatment in prison.

Mizner is serving 19 years in Queensland for 65 child sex offenses against the then-toddler daughter of a girlfriend whom he repeatedly raped over a three-month period in the early 2000s.

After claiming he was tortured at Wolston Correctional Center earlier this month — a claim that was refuted by prison officials — Mizner has gained the support of a fellow inmate who will support his claims.

The Queensland Civil and Administrative Court agreed that the witness could testify while his identity was suppressed due to his ‘fear of retaliation from other prisoners’.

Mizner, a former yoga teacher, claims the prison lights and noise from other inmates at Wolston are causing the PTSD he suffers from being incarcerated in Thailand.

He was serving 11 years of a 35-year prison sentence after he was caught sexually assaulting the daughter of a Thai woman he befriended in Chiang Mai city.

Mizner was deported and arrested on his return to Brisbane, and pleaded guilty to more than 60 child crimes from the early 2000s, including more than 30 counts of rape and videotaping the assaults.

Along with Mizner’s tapes of the assaults and the names of children, police found a bag containing the addresses of single mothers and plans for a child exploitation ring.

His lawyers blamed a motorcycle accident at age 21 for his loss of “inhibitions” with children, claiming he was beaten and tortured while in prison in Thailand.

Last year, Mizner filed a petition asking for a private cell in the overcrowded Wolston facility because of his hypersensitivity and “anxiety level or traumatic mood swings.”

He claimed sleep disturbances from noises and lights when cellmates used the toilet in the middle of the night.

The child predator told the tribunal that he would be awakened by people “going about their business” and when they “turned on the lights.”

He claimed he was not allowed to have earplugs and that stuffing rags in his ears left him “scratched” and “bleeding”.

However, former general manager of Wolston Prison, Joel Smith, testified that there was no blanket ban on earplugs and he was unaware that Mizner had ever asked for one.

Two further half days of hearings on the baby rapist’s allegations will take place on dates to be determined.

Mizner had tried to close the hearing and hear evidence in closed sessions, but that request was denied.

The tribunal also rejected Mizner’s bid for a non-publication order, which he said was done in the best interests of his victims’ families.

During his 2018 sentencing for his crimes in Queensland, the judge said she had struggled to view the disturbing footage of Mizner’s crimes, despite 30 years of experience dealing with cases of extreme child abuse.

Justice Leanne Clare, who was so traumatized by the graphic images that she delayed sentencing, said: ‘I only saw part of it and it was a struggle to get the vision of your offense out of my head.

“I can’t imagine the horror of it for (the girl’s) mother.”

Mizner lost an appeal against his sentence in 2019 and his earliest release date will be in 2031.
