Former swim coach Kyle Daniels will not face a third trial on allegations that he sexually touched underage girls during swim sessions, a court heard.

The Sydney Downing Center District Court was told on Friday that the Director of Public Prosecutions would not proceed with any further legal action against the 24-year-old.

The decision comes less than two months after a jury failed to reach a verdict on more than half of the allegations that Daniels sexually touched nine girls on Sydney’s North Shore between 2018 and 2019.

Former swim coach Kyle Daniels will not face a third trial on allegations that he sexually touched underage girls during swim sessions, a court has heard.

The Sydney Downing Center District Court was told on Friday that the Director of Public Prosecutions would not proceed with any further legal action against the 24-year-old.

Daniels was found not guilty on 10 of the other counts against him, with the jury returning verdicts on five, four and one count over the course of three days a week.

These included the most serious allegations that he had inserted his fingers into the vaginas of some of the girls, who were charged under the law with having sex with a child under the age of 10.

However, the jury was acquitted when they could not reach a verdict on six counts of sexual touching of a child and five counts of indecent assault.

Mr. Daniels pleaded not guilty to all charges in court and has always denied any wrongdoing.

On Friday, the court heard that the DPP would drop the charges and that Daniels would not have to endure a new trial.

Judge Kara Shead noted that there was a request for costs that will be heard in March of next year.
