Western Sydney man jailed over repeated and brutal attack of a boy who spent two months in hospital

A western Sydney drug addict who repeatedly and brutally beat the five-year-old son of his lovers in a child abuse case that shocked doctors has been jailed for a decade.

The 23-year-old man – who cannot be identified due to the risk of identifying his young victim – appeared this week in Parramatta District Court, where he met his fate for what a judge described as ‘fierce, sadistic’ and ‘ dragged on’. brutality’ on the boy.

He was arrested in August 2020 after police were called when he was heard punching and yelling at his victim.

The court heard that the man was 20 years old and married in March 2020 when he began having an affair with the boy’s mother.

Earlier this month, the Director of Public Prosecutions dropped the last of the remaining charges against the woman, who also cannot be named.

Another woman, who lived with the mother, saw in April 2020 the man yelling at the boy “you don’t know how to discipline him, let me do it” and standing on him with a broomstick.

The court heard that after returning to her room, the woman heard “something” being hit five or six times and the boy pleading: “Mom, please save me.”

The incident went on for an hour, the court heard.

Judge Andrew Colefax told the court that the housemate heard similar incidents on seven or eight other occasions, however the man was not charged for those incidents.

The man was charged for another incident in which the housemate heard the man beating the boy during which he yelled, “Mom help me, Mom save me.”

Photos taken by the victim’s mother showed him with red marks on his face, neck, thigh and buttock.

Another assault in August 2020 left the boy with facial bruises, scratches on his face, chin and chest, and a swollen lower lip.

The man was finally arrested on August 28, 2020 when a man, who had recently moved into the mother’s unit as a housemate, heard sounds that were “consistent with you hitting and yelling” at the boy.

The housemate called the police, but when the officers arrived, the man did not allow them to enter.

‘The police found (the mother) in the bathroom. She was holding (her child) in her arms,’ Judge Colefax said.

‘(The boy) was visibly bruised and cut. His eyes were open, but he seemed semi-conscious.

The man admitted to hitting the boy with a broomstick and splinters and blood were found covering the floor and a mattress.

When the boy was brought to Liverpool Hospital, he was lying in the fetal position, mumbling and making “incomprehensible sounds”, the court was told.

She had to undergo an emergency transfusion due to blood loss, she had extensive abrasions and bruises.

He was transferred to Children’s Hospital in Westmead, where he spent two months.

The court heard the sickening details of his extensive injuries, which included acute traumatic brain injuries, severe head injuries, retinal hemorrhages, fractured ribs, a fractured spine, a fractured forearm, and multiple abrasions, bruises, and soft tissue injuries.

She also suffered burns to her buttocks which “were probably caused by a hair dryer”.

The court heard that the boy had made a slow recovery but needed help to walk, with the help of a frame and pelvic belt, dress, bathe and eat, and was learning to write again.

The court heard that he will require ongoing psychological treatment for trauma.

Upon his admission to hospital, pediatric neurosurgeon Adam Fowler tweeted that it was the “worst case of suspected child beating” he had seen in his professional career.

“One that made me physically cry while examining,” Dr. Fowler tweeted.

He pleaded guilty to grievous bodily injury and assault causing actual bodily injury.

The court heard that the man reported using methamphetamine on a daily basis.

He reported to a psychologist that he had ‘hit’ and ‘shaked’ the children.

But Judge Colefax said: “These bland descriptions do not accurately describe the ferocious, sadistic and prolonged brutality you inflicted on this vulnerable child.”

In a remorseful letter, the man told the court: “I accept that I deserve to be severely punished.”

However, Judge Colefax said he was not satisfied: “on the balance of the odds, he is truly sorry for his offence”.

The man was sentenced Friday to 10 years in prison, with a seven-and-a-half year non-parole period.

Having been in prison since his arrest in August 2020, he will be eligible for release in February 2028.
