Major update after two brothers, aged nine and 10, were killed when Subaru Impreza smashed into a tree
An Audi driver has been charged with manslaughter after two brothers died in a car crash when the Subaru Impreza they were driving crashed into a tree.
Brothers Xavier, 10, and Peter Abreu, nine, died after the sedan crashed into the tree on Grand Parade in Monterey, Sydney, at 9.50pm on August 25, 2023.
It emerged on Thursday that a 25-year-old man is now facing two additional manslaughter charges over the boys’ tragic deaths.
The boys’ cousin, Jimmy Brito, 33, was driving the car they were in and was charged with two counts of aggravated dangerous driving causing death and one count of causing bodily harm by misconduct.
The 25-year-old, who drove an Audi and was said to have been racing Brito on the street before the crash, had previously been charged with offenses including aggravated dangerous driving causing death, and two charges of failing to stop and render assistance after a collision resulting in death.

After ‘further investigation’, the police announced that he has also been charged with two counts of manslaughter.
He will appear at the Downing Center Local Court in Sydney’s CBD on May 2.
Brito, who is in custody, will also appear in the same court on the same day.
A 24-year-old woman, who police say was a passenger in the Audi, was charged with concealing a serious criminal offense and remains on conditional bail.
She is scheduled to appear in court on April 11.
At the time, Detective Jason Hogan described the crash scene as gruesome.
“It is a particularly nasty crash in which two innocent young children have lost their lives,” he said at the time.
Police alleged in court documents that Brito was driving in a “manner dangerous to another person” at the time of the collision.
The Abreu boys’ cousin, a nine-year-old girl, was also in the car and suffered minor injuries.

The boys, who were in the back seat, were freed from the wreckage and rushed to Sydney Children’s Hospital in Randwick, where they died shortly afterwards.
The girl, who was sitting in the front passenger seat, was also taken to hospital with minor injuries.
The boys are survived by their father Samuel, mother Olimpia Aliferis, stepmother Jivonne Garrido and brothers Alex and Jacob.
