The five-judge panel ruled that Trump’s fine for failing to comply with a subpoena for the records was a “proper exercise” of Manhattan Supreme Court Justice Arthur Engoron’s discretionary power.

The $10,000 per day penalty was not excessive or improper under the particular circumstances, according to the decision.

Attorney General Letitia James praised the two-page ruling issued by the First Judicial Department of the Appellate Division of the state Supreme Court.

“For years, he tried to stop and thwart our legal investigation into his financial transactions, but today’s decision sends a clear message that there are consequences for abusing the legal system,” he said. “We will not be intimidated or deterred from seeking justice.”

The judge imposed the fine on Trump last spring after ruling that he had repeatedly failed to provide James’ investigators with the Trump Organization business records they were seeking for the investigation of his real estate company.

‘Mister. Trump has willfully disobeyed a legal court order,” he wrote in the opinion.

Trump later paid the fine, but appealed the contempt of court ruling.

New York state filed a $250 million lawsuit against Trump, his company and three of his adult children in September, accusing them of ongoing, systemic fraud involving decades of financial statements.

The New York civil fraud investigation hinges on whether the Trump Organization deliberately misrepresented the valuations of its real estate holdings on official documents for illicit gains, according to USA Today.

In addition to financial damages, the Attorney General’s office seeks to bar Trump and his three adult children: Donald Trump, Jr., Eric Trump, and Ivanka Trump from serving as executives of a company in New York and to prevent named Trump companies from in the suit back to do business in New York.

A Trump spokesman did not immediately respond to a request for comment.
