Donald Trump could be caught off guard by a so-called surprise in October, which would destroy his chances of retaking the White House.

Former Bush official John Yoo has warned that the former president could be in jail as early as next month.

Trump is desperately trying to delay his sentencing hearing until after the election after he was convicted by a Manhattan jury on 34 counts of falsifying corporate records.

But controversial judge Juan Merchan has consistently rejected his appeals.

John Yoo agreed, explaining that a possible prison sentence is “the October surprise that won’t happen until September.”

“In five weeks, Judge Merchan will sentence Donald Trump,” the host continued.[Merchan has] again asked to step aside. He refuses to do so. How do you see this playing out? What does the judge do?’

Trump’s legal team has tried three times, unsuccessfully, to convince Merchan to withdraw from the lawsuit.

All efforts hinged on the judge’s daughter’s work as an adviser to Democrats, which the former president’s lawyers say is damaging to Merchan.

By invoking the Supreme Court’s recent ruling on “presidential immunity,” Trump is attempting to overturn his conviction.

If his attempt fails, the former president will be sentenced on September 18.

Yoo, a prominent law professor, praised Hemmer for taking the case’s scheduling into account.

“Bill, it’s great that you noticed how the calendar works this way,” the former Bush official said.

“Merchan has spoken out against Donald Trump at every opportunity,” Yoo continued.

According to the latest surveys, Pennsylvania is a key state currently trending toward Harris.

“What if Judge Merchan went even crazier and said that Donald Trump doesn’t have to stay out of jail at all while his case is on appeal?” the legal scholar continued.

“But this judge has repeatedly used his discretion to try to steer this trial in a political direction that will have consequences for the election,” the former Bush official concluded.

Trump’s lawyers are now trying to delay the verdict in the lawsuit until after the presidential election.

In a letter to Judge Merchan, Trump’s attorney Todd Blanche argued that the current scheduling risks “election interference.”

“Putting aside the election interference objections,” Blanche wrote, “there is no valid counterargument for the Court to keep the current date of the ruling on the calendar.”

“There is no reason to continue to act hastily.”
