Travis Scott has asked a judge to dismiss his trespassing charge, two months after he was arrested at a Miami marina following an altercation on a yacht.

The 33-year-old Sicko Mode rapper, who was recently released “without charges” following his arrest in Paris after a fight with his bodyguard, claimed there were no “no trespassing” signs at the Miami Beach marina, according to TMZ.

On Tuesday, the musician’s attorney, Bradford Cohen, filed a motion to dismiss the case after a second misdemeanor charge of disturbing the peace was dropped earlier this month.

The arrest came after the rapper was ordered by police to leave the premises, but he returned to retrieve personal items left on the boat.

Sources informed TMZ at the time when the musician’s decision to return ultimately led to his arrest.

But earlier this month, Scott’s DUI charge was dropped after a hearing, according to TMZTravis was not present at the most recent trial.

He is due to appear in court on September 10 for the offense of trespassing.

Travis was arrested overnight in June for public intoxication and public order offences at the marina, according to an affidavit seen by DailyMail.com.

According to court documents, Scott was booked into Turner Guilford Knight Correctional Center at around 4:35 a.m. for the two offenses.

The Houston-born rapper, who has two young children, Stormi and Aire, with Kylie Jenner, was arrested by police at 1:17 a.m. at the Miami Beach Marina.

He was involved in “a disturbance on a yacht” where people “were fighting,” police said. Scott’s attorney Bradford Cohen told DailyMail.com that the fight was verbal in nature and “there was absolutely no physical confrontation.”

Ten officers approached the boat and found Scott “standing on the dock, yelling at the occupants of the vessel,” the statement said.

They tried to defuse the situation by asking Scott to sit down, but he kept getting up and ignoring their commands, the reports said.

According to police, Scott smelled “a strong odor of alcohol” on his breath and Sergeant Lemus warned him to leave the dock or he would be arrested.

Eventually, Scott returned to his car and ordered one of his guards to get out of the SUV so they couldn’t leave the scene of the accident.

He then threatened his own guard, telling the officers, “If he gets in the car, he’ll get into a fight.”

The rapper eventually complied with the officer’s request to leave, but just five minutes later he turned around and returned to cause more chaos.

According to police, Scott began shouting again, becoming increasingly erratic and disturbing the peace of residents of the marina and nearby residential buildings, causing a public unrest.

He was detained and taken to Miami-Dade Correctional Facility. When asked if he had consumed alcohol, Scott said “it’s Miami” and admitted that he had.

Scott posted $650 bail, with $500 for the trespassing charge and $150 for drunkenness and disturbing the peace.

Scott’s attorney Bradford Cohen told DailyMail.com that the rapper was “briefly detained due to a misunderstanding.”

“There was absolutely no physical confrontation and we thank the authorities for their cooperation in a swift and amicable resolution,” Cohen said.
