Kanye West’s wife Bianca Censori’s gangster uncle is being ordered to foot the bill for police lawyers after he deliberately delayed his legal proceedings.

Eris Censori, who was once sentenced to death in Western Australia for the murder of a waiter, was nicknamed the ‘Al Capone of Melbourne‘ before his life of crime came to an end.

Ny Breaking Australia reported in May that the notorious criminal could face another life sentence after being involved in a police operation while living with a suspected paedophile.

Although Censori was acquitted, the arrest still landed him before the Adult Parole Board, where he risked being sent back to prison to serve out his life sentence.

In a writ filed in the Supreme Court of Victoria against the State of Victoria, Censori alleged that the search warrant that brought him before the Parole Board was obtained “through misconduct and in the absence of facts.”

The court heard on Wednesday that the case was at risk of being terminated if Censori continued to delay the proceedings, which began in August last year.

Censori was arrested by Victoria Police detectives in September 2020 on suspicion of fraud.

But the discovery of a cell phone belonging to his roommate—allegedly containing child pornography—threatened to land him back in prison for good.

Censori, who has changed his name to Tony Campana, claims his arrest “tarnishes” his good character and “causes him to be publicly ridiculed, shamed and scorned.”

The court heard that Censori had initially defended himself in court, but had soon opted to hire a legal team.

Although now represented by a lawyer, the court heard that Censori had failed to comply with orders given to him on July 17 to amend his summons.

“That did not happen,” Censori’s attorney Tim Sowden told the court.

No reason was given for the delay. Mr Sowden stated that his client would comply with the orders within two weeks.

Daniel Wallis, acting for Victoria Police and the state government, said he was concerned that Censori would continue to cause delays and would therefore apply to have the case thrown out of court.

“The first orders were given by Your Highness in December last year,” he said.

The court ruled that Censori had until December 22 to comply with the orders, but he did not do so.

“Following further email exchanges, Your Highness issued further orders in July last year, but … these too went unheeded,” Mr Wallis said.

‘There have been two failures to comply with an order. A lot of time has been lost in this case, because the defendant is in a position where it was previously announced that he would drop the case.’

According to Wallis, that request will likely be filed if Censori does not comply with the orders by Wednesday.

“That’s why we’re here and that’s why we’re concerned,” he said.

Judicial Clerk Baker took aim at Censori’s attorney, stating that his client did not exactly have a good track record when it came to complying with court orders.

He warned Censori that if he did not comply this time, the case would be dropped out of court.

“Either way, we’ll know what happens before then,” Baker said.

Wallis’ lawyer did not oppose Censori’s request to pay his legal fees for Wednesday’s hearing.

“We are saying we simply should not have been here today,” Mr Wallis argued.

Mr Sowden agreed.

“I’ve gotten into a bit of trouble so I’m not going to bang the bar table about it,” Mr Sowden said.

The case is expected to return to court next month, where it will either be continued or dismissed.

Censori avoided the death penalty for the murder of waiter Michael Sideris in the 1980s because the death penalty was abolished in Western Australia in 1984, before he could be executed.

He is the brother of Bianca’s father Elia ‘Leo’ Censori, who also served a lengthy prison sentence after being convicted in 1982 of possession of a prohibited import. after a raid by the Australian Federal Police found heroin in his kitchen.

Ny Breaking Australia revealed last year that Leo was also convicted of possessing a pistol and ammunition and served two years of his five-year sentence for the drug charges.

Their eldest brother, Edmondo, better known as ‘Eddie Capone’, has also been convicted in Victoria for violence, including assault on police, robbery and making threats.

In documents tendered to the court, Bianca’s uncle alleges police used his sale of a Brunswick property to obtain a search warrant, under the guise of investigating alleged fraud against the Bank of Queensland.

When Censori was arrested, he was sharing a room in Bulleen, north-east of Melbourne, with two other men.

“(Censori) was in his bedroom, which overlooked the courtyard, when he saw the gate open and a company of six large men entering, all armed with handguns,” the documents said.

‘(He) immediately suspected that the escorts were members of the Victoria Police. The thought filled him with fear.’

Police alleged that the property he sold in Brunswick was purchased from him with fraudulently obtained money.

“I think you made a mistake. I’m the seller. I didn’t get any money from a bank,” Censori told investigators.

Censori claimed that police escorted him to his bedroom and asked him to hand over documents relating to the sale. He was then asked to access his phone and computer.

“When the search was completed, (Censori) was shown a cell phone that had been found in another resident’s bedroom. Questions were then asked about the resident of the bedroom and the contents of the cell phone,” the documents state.

Censori claimed that the chief detective told him that he knew he had been convicted of murder, that he had served a long prison sentence and that he still had to report to the parole board 25 years after his release.

“Any criminal charge, even a charge of involvement in a crime, could result in a violation of my parole, which could result in me going back to prison and ultimately being deported,” he told the detective.

After the search, Censori said he was handcuffed and paraded in front of his neighbors, after which he was taken to the police station for questioning.

After Censori was fingerprinted and questioned by police, he was released without charge.

Censori claimed that the parole board caught him in January 2021 and questioned him about his relationship with the suspected pedophile.

Censori claimed that he had told the board that he nhis relationship with his roommate, known as ‘Mohamed’, and knew nothing about the contents of his phone.

When the case was brought to court, Censori alleged that the lead detective had “committed defamation” [scornful] contempt for [his] right to privacy and liberty, the malicious infliction of harm’.

In a long list of allegations, Censori claimed that police searched bedrooms and seized items outside the scope of the warrant and that they “deliberately created the impression that he was involved in someone else’s crime.”

He further accused the police of assault, unlawful arrest and detention, and initiating a malicious prosecution.

In a statement responding to the claim, Victoria Police defended the manner in which they arrested Censori.

‘(Censori) was arrested for conspiracy to defraud the Bank of Queensland and (he) was given a formal caution, after which (he) stated that he understood,’ the defence said.

Police deny attacking Censori, unlawfully arresting him or maliciously prosecuting him.

Suggestions that Censori’s arrest had “tainted” his good character were also refuted.

“The court denies that it defamed the plaintiff and further states that the summons discloses no basis for a claim for defamation,” the government’s lawyers said.

‘It denies that any matter published or caused to be published by the defendant has caused or is likely to cause serious damage to the reputation of the plaintiff.’
