Three men accused of gang rape during a weekend getaway at an Airbnb apartment met their first alleged victims – two 18-year-old friends – at a nearby pub.

Groom Andrew David and brothers Maurice and Marius Hawell were among a group of nine men who rented a three-bedroom property in the NSW Hunter Valley two years ago.

David and the Hawell brothers arrived at the first floor apartment on Parry Street in Newcastle West at around 6pm on Friday, February 25, 2022, with the others turning up later.

The Airbnb was located 900 feet from the Cambridge Hotel, where two 18-year-old friends met around 8:50 p.m. after getting ready for a night out at one of their homes.

David, then 28, Maurice Hawell, 27, his brother Marius, 20, and two other members of their money group walked to the Hunter Street pub where they were filmed entering at around 9.20pm.

What allegedly happened the rest of that night and the following evening was set out on Wednesday at the Downing Center District Court, where David and the Hawells are on trial.

All three are accused of raping the two 18-year-olds and a 19-year-old woman on Saturday evening. Some of the alleged sexual acts are too explicit to report.

Crown prosecutor Craig Evans told a jury that the two women, Miss A and Miss B, had interactions with the Hawells and their friend Matt Anoih, who kissed Miss A in the pub.

Mr Evans said Mr Anoih, who is not accused of ever committing any wrongdoing at any point, later asked Miss A to return to the Parry Street apartment.

‘I’m not going alone, alone as my friend [Miss B] can come,” she allegedly said.

Maurice Hawell is later said to have said to Miss B, “Would you like to come back to our apartment – you and your twin sister?”

The two teenagers, Maurice Hawell and Mr Anoih, reportedly left the pub at 11.09pm, followed by Marius Hawell at 11.15pm and David at 11.28pm.

Mr Evans said that once inside the apartment, Maurice Hawell and Miss B went to one bedroom, while Mr Anoih and Miss A went to another.

Mr Anoih and Ms A were having consensual sex and were chatting on the bed when the door opened and Maurice Hawell allegedly walked in without clothes.

“Can I come with you and Matt?” Maurice Hawell reportedly asked.

The court heard when Miss A rejected Hawell’s request, he said: ‘I’m a better carrot than Matt’, but she repeatedly said: ‘No, go away’.

Mr Evans said that by then Maurice Hawell and Miss B had already had consensual sex, during which he said: ‘Can one of my friends join in?’

After initially saying no, Miss B allegedly asked who Hawell wanted to join them and he replied: “It’s actually my twin brother.”

Mr Evans said Miss B agreed and another man entered the room who the Crown alleges was not Hawell’s brother but David.

As Maurice Hawell and Miss B continued to have sex, David reportedly said: “It’s really hot, can I take my pants off?” and she replied, ‘Do whatever you want.’

Mr Evans said Miss B then performed a sex act on David and the pair had consensual intercourse after Maurice Hawell allegedly bit her nipple.

Marius Hawell then allegedly entered the room and said to Miss B, “Hey, how are you feeling?” and she replied, β€œOkay.” He allegedly touched her sexually.

Mrs. A met Mrs. B in the kitchen of the apartment, where they discussed leaving. They went into a bedroom to get their phones and found the lights were off.

Mr Evans said Miss A then felt someone grabbing her, ‘hands everywhere’ and ‘a swarm of people’ towards her.

As Miss A was reportedly pushed onto the bed and some of her clothing removed, she said, “Where’s Matt” and “None of you are Matt.”

Mr Evans said Miss A and Miss B were then subjected to various non-consensual sex acts by numerous men, sometimes at the same time.

At one point, when Miss A reportedly asked, “Is that Matt?” a male voice said, β€œYes, I’m Matt,” and another said, β€œNo, I’m Matt.”

At another point, Mr Evans said Mr Anoih entered the room and Miss A said to him: ‘I want your friends to stop’.

Mr Anoih is said to have spoken to the men in the room, who left, and then asked if Miss A was all right. “I’m fine,” she is said to have replied. ‘Where is [Miss B]?’

Mrs B is then said to have said in the darkened room: ‘I am here’.

Miss A and Miss B were unable to identify who committed each alleged act against them, but the Hawells and David are accused of taking part in a joint criminal enterprise.

Mr Evans said the women returned to Cambridge with Mr Anoih and Miss A told a friend: ‘We messed up. It was really good with Matt. But it looked like an orgy. There were so many guys it was crazy.”

Ms. A allegedly did not report non-consensual sex that evening and Ms. B did not report her alleged assault to anyone until early 2023.

The following evening, Maurice Hawell reportedly met a 19-year-old woman, Miss C, in Parry Street and said to her: “My friends are all having a drink upstairs,” referring to the apartment.

Mrs C agreed to come upstairs and once inside, Maurice Hawell allegedly led her to a bedroom.

“What about the drinks beforehand?” she reportedly asked. β€œWe’ll get to that,” he allegedly replied.

Mr Evans said Hawell pushed Miss C to the bed and took off some of her clothes. Ms C reportedly saw a naked man who the Crown said was David lying next to the bed.

Mr Evans then described a series of allegedly non-consensual sexual acts committed by Maurice Hawell and David against Miss C, including sexual intercourse.

The Crown alleges Marius Hawell entered the room and watched.

When Miss C left the apartment, she called her roommate and then triple zero.

Maurice Hawell and David were subsequently charged with eight counts of aggravated sexual assault in company and one count each of aggravated sexual touching of another person and attempted aggravated sexual assault in company.

Marius Hawell was charged with six counts of aggravated sexual assault in company and one count of aggravated sexual touching of another person and attempted aggravated sexual assault in company.

They have all pleaded not guilty to each charge.

Richard Pontello SC, for Maurice Hawell, told the jury his client denied some of the acts took place and said all others were consensual.

“There was no sexual touching without anyone’s consent,” he said.

‘There was no sexual intercourse without anyone’s consent. There was never any attempt made by anyone to do any of these things.’

Scott Corish, speaking on behalf of Marius Hawell, said his client was not involved in sex or a joint criminal enterprise.

Sharyn Hall SC said for David that all of her client’s sexual acts were consensual and asked the jury to carefully consider the complainants’ evidence.
