Sofia Vergara’s ex-fiancée is still fighting in court over the couple’s frozen embryos, but this time he’s suing the fertility clinic they used.

Nick Loeb previously lost a lawsuit to gain custody of the two frozen embryos he and Vergara created when they were together in 2013.

The couple split in 2014 and Sofia, now married to Joe Manganiello, didn’t want her ex to be able to bring them to the end.

It was a bitter court case that dragged on for years, but finally in 2021 a judge sided with her and issued a permanent injunction preventing Loeb from accessing them.

Loeb is suing the ART Reproductive Center in Beverly Hills, claiming that the doctors never informed him that the embryos would be destroyed, or that Sofia could deny him access to the embryos if they separate.

Loeb, who describes himself as “pro-life” and pro-parenthood, is a film director and actor with an impressive background of American dynasty families.

His family tree includes Seagram heirs the Bronfmans, the Lehman family of the now-defunct Lehman Brothers bank, and the Loeb family of Loeb, Rhoades & Co.

In lawsuits, he alleges medical malpractice by ART, despite admitting he signed a contract stating what would happen to the embryos in the event of a rupture (he says he signed a second document contradicting the first ).

“I would never have gone ahead with creating what Sofia and I considered lives if I knew she wouldn’t consent, or wanted to thaw and destroy the embryos, in the event of a rupture,” he said in the most recent filing.

Loeb is seeking damages from ART to cover his legal costs.

A judge previously ruled that he cannot claim compensation later because of not having the children.

He and Vergara were together for four years before calling off their engagement in 2014.

They had already been to ART and had frozen the embryos.

Vergara, now 50, already had an adult son.

In 2017, three years after their split, she filed legal papers to deny Loeb access to the embryos.

It was a battle that lasted four years, until a judge rejected his latest appeal in March 2021.
