Reese Witherspoon finalizes her divorce from Jim Toth and signs off on their son’s parenting plan…four months after ending 12-year marriage

Reese Witherspoon has settled her divorce from Jim Toth just four months after filing the paperwork to end their 12-year marriage.

The Academy Award winner, 47, and the CAA talent agent, 53, have both signed a prenuptial agreement according to TMZ.

The actress and producer – who was recently spotted on a romantic vacation with a new wife – also signed a parenting plan for their 10-year-old son, Tennessee James.

The Legally Blonde star officially filed for divorce from Toth in April, a week after they announced the end of their marriage. She cited irreconcilable differences as the reason for their split in court documents.

This is Reese’s second divorce. She previously divorced Ryan Phillippe, 48, in 2008 after 9 years of marriage and two children: daughter Ava, 23, and son Deacon, 19.

Witherspoon and Toth’s divorce papers were filed in Nashville, Tennessee, where the couple lives with their son.

The documents show that the couple agreed to a prenuptial agreement in March 2011.

Reese indicated the contract was valid and provided “adequate provisions” for their assets and liabilities,” TMZ reported at the time of the filing.

Reese noted that she will submit their prenuptial agreement and permanent Tennessee parenting plan to the judge for approval.

Since the divorce was filed in Davidson County, Reese and her estranged husband will now have to take mandatory parenting classes. They have 60 days to present a certificate of completion to the court.

The filing came a week after Reese and Jim announced their separation on social media, just two days before their 12th wedding anniversary.

A source has since provided some insight into their recent decision to end their marriage.

The insider told People that it was “really difficult” for the movie star to accept that she and her ex-partner were “two very different people.”

Someone close to the two noted that the aspiring producer “has her hand in a lot of pots” and that Toth “prefers less frenzy.”

It added, “They spent less and less time together while she was at work.”

More than a decade after they tied the knot, the long-time duo recently “discovered that they had fewer interests in common.”

Reese is described by a source as “quirky and focused” and Jim is said to be “more relaxed.”

The Pleasantville actress spent more time in Nashville in 2022 while working on the production of the Apple TV music competition show My Kind of Country.

She also flipped a local home for nearly twice the price of what she paid for the home.

Mother-of-three company Hello Sunshine also produced the Amazon series Daisy Jones & the Six.

Reese has also been busy filming season three of The Morning Show, in which she stars opposite Jennifer Aniston.

Meanwhile, Toth has retained a seat on the board of directors of Flowcode, a technology company. Before that, he left talent agency CAA to work briefly at the failed streaming platform Quibi.

Per Reese’s solemn divorce announcement shared last week, the twosome decided to go their separate ways with “great care and consideration.”

A source said the partners were “working on” their issues and it took them a long time to get to a divorce.

That’s what a source said earlier Page Six that the impending divorce was a “poorly kept secret” in Hollywood for months.

Earlier this week, it was also shared that Reese is “angry” about the end of the marriage.

Reese and Jim got married in March 2011 and soon after welcomed their son, Tennessee.

The Big Little Lies actress and the talent agent’s split announcement read, “We have some personal news to share… It is with great care and consideration that we have made the difficult decision to separate.

“We have enjoyed so many wonderful years together and move forward with deep love, kindness and mutual respect for all we have created together.

“Our number one priority is our son and our entire family as we navigate this next chapter.

“These are never easy matters and extremely personal. We greatly appreciate everyone’s respect for our family’s privacy at this time.”

But there’s no mess: “There’s no drama,” the People insider stressed. “They love (their son) Tennessee and this is their focus. They remain co-parenting amicably.”
