Porsche driver Richard Pusey is to be released from jail within days after being jailed for sending graphic photos of dying police officers to the financial services watchdog.

Footage of the April 2020 crash on the Eastern Freeway that killed four police officers was attached to a November 2021 complaint Pusey sent to the Australian Financial Complaints Authority.

Pusey, who uses they/them pronouns, was found guilty by magistrate Michelle Mykytowycz of using a carriage service to offend by the use of ‘terribly graphic’ imagery.

They had filed a complaint with the authority after PSC Insurance Brokers, backed by Dawes Motor Insurance, refused to pay compensation for their 2016 Porsche 911, which was significantly damaged in the accident on the Eastern Freeway.

Pusey had made a $2.2 million insurance claim on the car, which was valued at $415,000.

Mykytowycz said it was hard to conceive of a more serious example of the crime of which Pusey was found guilty.

Each of the four images showed one or more of the deceased officers, with the circumstances of their deaths and injuries displayed.

“Once viewed, these images cannot be unviewed,” he said.

Its use in the complaint was nothing more than gratuitous and denied the dignity that each of the officers deserved, he said.

Pusey had expressed in the complaint to the authority how graphic and traumatic the scene was, but he took the unreasonable risk of sending the images, without any warning of their graphic nature, to an organization that existed to help him with his financial concerns, the court noted. magistrate.

Harry Ganavas, who received the images, described being repulsed and feeling physically sick after viewing them.

Ms. Mykytowycz added that Pusey also needlessly and callously described the officer’s deaths in the text portion of the complaint.

He stressed the need to deter their ongoing criminal conduct with their sentence, noting that they had a continuous attitude of disobedience to the law.

Pusey was sentenced to 10 months behind bars. With time up, he expected them to be released in days.

Ms Mykytowycz was also forced to view the graphic images as part of the hearing in the case and spoke candidly after sentencing about the high regard she holds for first responders.

“Frontline first responders … do a remarkable job and I can only think they must suffer some level of cumulative trauma at the larger events they attend,” he said.

“I really want to pass on my thanks and gratitude to the first responders on the front lines.”
