Patagonia has filed a lawsuit against retail chain Nordstrom, with the outdoor clothing giant accusing them of selling “thousands” of fake Patagonia sweatshirts and t-shirts in their stores.
They are seeking up to $150,000 for each “work” that was infringed in the federal lawsuit, which was filed Tuesday in a California district court.
Nordstrom operates approximately 348 “Nordstrom Rack” locations in 41 states, intended as sisters to the classic, upscale Nordstrom stores.
Patagonia alleges that Nordstrom is confusing customers and diluting their brand by selling counterfeit products at Nordstrom Rack locations.
The brand and retail company had ended an 11-year relationship last year to sell merchandise.

The lawsuit alleges that they “brought this issue to Nordstrom’s attention and requested that the company voluntarily recall the products or reimburse customers” in an effort to avoid litigation.
However, Nordstrom did not recall the “mislabeled fakes” and furthermore, Patagonia claims, he “did not even inform his customers that they had purchased counterfeits of inferior manufacture and quality.”
Patagonia says they should sue Nordstrom to prevent further damage [its brand] and consumers.’
They claim that this is a violation of intellectual property rights and trademark infringement.
Patagonia is requiring Nordstrom to recall all counterfeit Patagonia products sold.
If the lawsuit is successful, Nordstrom could be forced to stop selling its items and pay damages, according to msn.
A spokesperson for Nordstrom said: Seattle Times that they are aware of the lawsuit and assess it.

Nordstrom was an authorized retailer of Patagonia clothing from 2010 to 2021. They sold what they had left in stock since the end of the deal.
It comes at a bad time for Nordstrom, which recently cut nearly 400 jobs as it prepares to close all of its stores in San Francisco.
According to official documents, a total of 379 jobs will be cut at the department store, which is located in the Westfield San Francisco Center shopping mall, and at the Nordstrom Rack outlet a few doors down.
Nordstrom is one of many retailers affected by the so-called “retail apocalypse” gripping the country.
