One of the migrants released without bail after being accused of assaulting two NYPD officers in Times Square has been arrested after allegedly committing another crime.

Darwin Andres Gomez-Izquiel, 19, is one of seven migrants charged by Manhattan District Attorney Alvin Bragg over the Jan. 27 Times Square melee.

He was one of four indicted migrants who were believed to have fled New York after being controversially released without bail.

But police say Gomez was seen Tuesday along with three other suspects trying to steal about $608 worth of items from a Macy’s store in Queens.

When confronted by a store security guard, a struggle ensued before one of the suspects punched the employee, police said.

“(Gomez) acted as a lookout with a group of three unapprehended others, who hid merchandise in the store and passed through all points of sale without paying,” the NYPD said in a statement.

Gomez was initially able to run from police but was taken into custody later on Tuesday.

Before his arrest, Deputy NYPD Commissioner Jaz Daughtry said, “One of the migrants who attacked our officers in Times Square last week is at it again.

“This time he was part of a group that robbed a department store in Queens. They also assaulted an employee. Different community, different crime – same disregard for the law.

“This is the last thing New Yorkers need. Hey Darwin, we see you – and you’ll be captivated again soon.”

The three other suspects, two men and a woman, are still on the run.

Last week, DA Bragg announced the charges against Gomez and six others accused of attacking two New York City Police Department officers in Times Square.

Up to fourteen men are believed to have been involved in the attack, although NYPD officials have repeatedly revised the number of suspects.

Four of the charged migrants are believed to have fled New York after being arrested and released without bail: Gomez, Kelvin Servita, Wilson Juarez and Yorman Reveron.

ICE initially said it had apprehended the four suspects in Phoenix, but the Manhattan district attorney’s office has denied that they are the suspects believed to have fled.

Gomez was charged with two counts of second-degree assault and one count of second-degree obstruction of governmental administration.

He is accused of grabbing one officer and kicking the other during the fight.

According to the criminal complaint, the attack occurred after two police officers ordered the suspects to move to West 41st Street. When an officer grabbed Brito and pushed him against a building, Brito tried to escape and struggled with the officer while being held on the ground.

That’s when the other migrants jumped in and began attacking police, police said.

New York City in particular has struggled under the weight of tens of thousands of migrants arriving at its borders in need of places to stay and other accommodations.

In 2023 alone, the city had to deal with the arrival of more than 170,000 migrants.

Mayor Eric Adams has said the cost of New York City’s migrant crisis is as much as $4.6 billion as he begs the state for more money.

New York State Governor Kathy Hochul last month pledged to spend $2.4 billion on the crisis, more than double last year’s proposal.
