Genaro claims his doctor had prescribed him a three-day medical leave in 2021 to deal with the stress of Wilde and Sudeikis’ messy split.
But when she told Sudeikis, the lawsuit claims, he “fired her on the spot.” She is now seeking back payments, punitive damages, and the costs of attorneys’ fees.
Genaro previously told DailyMail.com how the Horrible Bosses star was texting him about his concerns when Olivia Wilde started seeing Harry Styles more often, before taking Genaro on a trip to London.
But the former celebrity couple was quick to respond to Genaro’s claims, calling them “false and defamatory.”
They repeated that claim in a statement to DailyMail.com about Genaro’s lawsuit, saying: “As parents, it’s incredibly upsetting to know that a former nanny to our two young children would choose to make such false and defamatory allegations about us publicly.”
“Your 18-month campaign of harassing us, as well as our loved ones, close friends and colleagues, has reached its unfortunate climax. We will continue to focus on raising and protecting our children in the sincere hope that he will now decide to leave our family alone.”
Genaro’s lawsuit details how she was allegedly put in the middle of the celebrity couple’s divorce after ‘Wilde abruptly left the home where she lived with Sudeikis, their two children and the plaintiff as [a] live-in nanny’ in November 2020.
“Wilde’s sudden absence from the home had an adverse consequence on his emotional state, including Sudeikis’s reliance on the plaintiff’s presence for support,” the lawsuit states.
“Although this shared trauma created a bond between Claimant and Sudeikis, Claimant became increasingly anxious and stressed by Sudeikis’s tendency to apparently require Claimant to stay up at night after the children went to bed to talk. whereas that dynamic did not occur before Wilde’s death.” absence.
“The subject of these late-night conversations with Sudeikis naturally evolved into discussing Wilde, in which the applicant felt compelled to participate despite creating her extreme anxiety, as she apparently felt she had to ‘choose sides’ between the parents of the children.” children that she was ostensibly the primary caretaker [of.]’
Casual: The newly single actress, 38, styled the look with matching skinny leggings and a pair of black sneakers
Beauty: Olivia removed her makeup and showed off her natural beauty while sporting a pair of black sunglasses.
Eventually, the lawsuit says, Genaro reached out to Wilde about the situation, which she said she thought went well.
‘The claimant felt a genuine sense of relief and camaraderie with Wilde, who reacted sympathetically from the claimant’s point of view: the claimant thought she had vented enough to be able to function without anxiety as the live-in nanny for Wilde’s children. and Sudeikis. with Wilde as a trusted ear,’ she says.
But when she, Sudeikis and the children were traveling to the airport in December 2020 to catch a flight to London, Genaro alleges, Sudeikis informed her that Wilde told her their entire conversation.
“Plaintiff was stunned by the abrupt announcement, and her heart sank at its significance: there was no peace when she trusted Wilde,” the lawsuit says.
He goes on to allege that Sudeikis then asked him “Do you trust me?” as part “gotcha”, part threat and part confirmation, the plaintiff was siding with Sudeikis.
By January 2021, Genaro alleges she told Sudeikis “her physical pain, anxiety, and stress,” and soon the group therapist everyone was seeing referred her to a doctor for “physical pain, anxiety, and stress.”
That doctor had apparently told Genaro that he needed to stop working for the celebrity couple, and on February 1, 2021, Genaro allegedly told Sudeikis about the doctor’s recommendation.
She “immediately added a desire to stay as long as possible, up to five months, so that a suitable nanny could be found to help with the transition for the children’s sake,” the lawsuit says.
The reaction of ‘Sudeikis’ to this verbal warning was moderate’, he affirms.
The next day, Genaro saw the doctor again and told him that his stress was increasing after the ad, according to the lawsuit.
Yikes: Wilde and Jason Sudeikis are being sued by their former nanny for wrongful termination. They are pictured together in 2013.
“The osteopath’s response to Plaintiff’s account of her physical and mental state that morning was to prescribe Plaintiff’s reaction of ‘radio silence’ from everyone, including Sudeikis, for three days,” the lawsuit states.
‘In other words, the claimant required a three-day medical leave due to her mental health, also known as stress leave.
“The osteopath passed this restriction on to the therapist, who passed it on to Sudeikis.”
Within hours, the lawsuit says, Sudeikis demanded to speak to Genaro.
“When the claimant replied that she was under the osteopath’s orders not to speak to anyone due to her anxiety, Sudeikis dismissed her on the spot and ordered her to [ML Management] to remove the Claimant from his home and take him to a hotel.’
Genaro then allegedly tried to contact Wilde’ for support in an attempt to help simply get his restrictions met, to no avail.
“Plaintiff is informed and believes, and therein alleges, that her termination was due to her anxiety/depression disability, and for seeking the reasonable accommodation of a three-day leave for the same,” the complaint states.
It argues that she “suffered and continues to suffer substantial losses in wages, benefits, and additional amounts of money.”
Genaro has previously made similar claims in exclusive interviews with DailyMail.com.
He said Wilde continued to text and voice messages her estranged fiancé throughout November and December 2020, but stopped after she was photographed in January 2021 with Styles at a wedding in Montecito, California.
The former House star had apparently left Sudeikis drunk and ranting ‘she left us’ at the children’s nanny after abruptly dumping him for the British pop star on November 8.
Still, Genaro said, Wilde would continue to return to the house in Silverlake, telling Sudeikis that he loved him. Those kind messages and visits continued until December 29, when Sudeikis and Genaro flew to London.
Wilde then went public with her relationship with her new boyfriend Styles five days later.
The nanny said she was floored by their debut as a couple, even though she knew about their affair and how heartbroken Sudeikis was that Wilde was with someone else.
The nanny told DailyMail.com: “When I saw Olivia holding hands as a couple with Harry on the news [in January 2021]I was surprised that just a month before, when we were in Los Angeles, she was texting Jason that she loved him.
‘Text messages and voice messages. He let me listen to voicemails and text messages. Then Jason said, she was right here [at the house] and she was naked in the pool and then she slept with me naked in bed.
She sent him voice messages saying that he was everything to her. There were many mixed messages.
‘How come she was just in this relationship and now she’s holding hands with a different person in front of everyone a month later? That was pretty shocking.
At the same time, Wilde, 38, was so enamored with Styles, 28, that the nanny claimed she even gave away her dog Gordon within weeks of meeting the British singer so she wouldn’t be tied down to caring for him and would be free. more time to spend with him.
Whirlwind: Wilde and Styles, who were romantically linked from January 2021 to November 2022, first met on the set of Don’t Worry Darling; The two appear in March in London, England.
The nanny said she then arranged for the Golden Retriever to live with Wilde’s dog walker in New York.
‘After [Wilde] left [at the start of November 2020], she came to visit and said, “we have to find Gordon a new home,” nonchalantly. Jason doesn’t really care about animals and he wanted them out of his house ASAP,” she said.
‘Jason said that Olivia only had the dog for appearances anyway. She rarely cared for Gordon or Paco, the dog she had before. It was me and others who took care of the dogs.
“I told Jason that I know someone who loves Gordon and was willing to accept him, so Jason said, ‘Let’s get him out of here right away.'”
