Olivia Wilde and Jason Sudeikis score a win against former nanny who claimed she was subjected to all-night teary chats, ‘gotcha’ questions and group therapy sessions with the couple before ‘wrongful termination’
Olivia Wilde and her ex-fiancée, Jason Sudeikis, won a major victory in their former nanny’s wrongful termination lawsuit against them.
On Wednesday, Ron Zambrano, representing plaintiff former nanny Ericka Genaro, confirmed to DailyMail.com that a judge has ruled that the case should be referred to arbitration.
“We don’t agree with the decision, but it is what it is and now we’re going to litigate it in arbitration and the case will move forward. This does not end the lawsuit. It just changes the location,” Zambrano explained.
The Los Angeles attorney continued, “As for the underlying facts, we have text messages and testimony that she was forced to quit and then summarily fired anyway. We have a lot of confidence in the case, so instead of taking this to court, we’re taking it to arbitration and we’re ready to move on.”
This comes six months after Genaro claimed in legal documents that she was fired by the couple when she applied for medical leave.
In her lawsuit, filed in Los Angeles County Superior Court, she stated that her doctor ordered her three days of medical leave in 2021 to deal with the stress of the couple’s public breakup.
After informing Sudeikis, she claimed in the lawsuit that he “fired her on the spot.”
The couple have vehemently denied the allegations.
Genaro has claimed overdue payment, damages and attorney’s fees.

Genaro previously told DailyMail.com how the Horrible Bosses star would text her about his concerns when Olivia Wilde started seeing Harry Styles more often, before taking Genaro on a trip to London.
But the former celebrity couple quickly hit back at Genaro’s claims, calling them “false and rude.”
They reiterated that claim in a statement to DailyMail.com about Genaro’s lawsuit, saying, “As parents, it is incredibly distressing to hear that a former nanny of our two young children would choose to make such false and egregious allegations in public. express about us.
Her now 18-month campaign to harass us, as well as loved ones, close friends and colleagues has reached its unfortunate peak. We will continue to focus on raising and protecting our children in the sincere hope that she will now choose to leave our family alone.”
Genaro’s lawsuit details how she allegedly found herself in the middle of the celebrity couple’s divorce after “Wilde abruptly left the house where she lived with Sudeikis, her two children and plaintiff as (a) live-in nanny” in November 2020.
“Wilde’s sudden absence from the home had a detrimental effect on his emotional state, including Sudeikis relying on Plaintiff’s presence,” the lawsuit alleges.
While this shared trauma created a bond between the plaintiff and Sudeikis, the plaintiff became increasingly anxious and stressed by Sudeikis’ tendency to seemingly require plaintiff to stay awake at night after the children were put to bed to talk, while those dynamic did not take place before Wilde’s absence.

Eventually, the suit says, Genaro contacted Wilde to talk about the situation, which she said she thought was going well.
Plaintiff felt a genuine sense of relief and camaraderie with Wilde, who responded sympathetically from Plaintiff’s point of view — Plaintiff thought she was getting enough of her chest to function fearlessly as a live-in nanny for Wilde and Sudeikis’ children, with Wilde as a trustworthy ear,” it says.
But when she, Sudeikis, and the children traveled to the airport in December 2020 to catch a flight to London, Genaro alleges, Sudeikis informed her that Wilde had told him about their whole conversation.
“Plaintiff was stunned at the abrupt announcement, and her heart sank at its significance — there was no peace when she confided in Wilde,” the suit says.
