More than 12,000 sign petition to kick out Alexee Trevizo from university after her bail was changed so she can go to classes despite being accused of murdering her newborn baby
More than 12,000 people have signed a petition to ban a New Mexico teen accused of murdering her newborn from attending college.
Alexee Trevizo, 19, gave birth to her son on Jan. 27 in a bathroom at Artesia General Hospital before disposing of his body in a garbage can.
The teen claims the baby boy “didn’t cry” when she gave birth to him and was stillborn, while prosecutors say she killed him by strangling him.
It has now emerged that more than 12,000 people have signed a petition to have Treviso kicked out of New Mexico State University in Las Cruces after a judge changed her bail conditions to allow her to attend her classes there in person.
The petition, started by Evelyn Grasiano on change.orgsaid it is “morally wrong” to allow Treviso to pursue higher education when she has been charged with an “heinous crime.”

“It is important to consider the impact this case may have on public confidence,” the petition reads. “Giving someone accused of murder access to education where other individuals are entrusted to him or her could undermine public confidence… and the justice system itself.”
The petition repeatedly mentions that Treviso is “pursuing a career in nursing or social work,” but there is no evidence to support this.
The petition came just days after a judge ruled that Treviso could attend her university classes in person during a hearing in Eddy County Court. Treviso, along with her attorney Garry C. Mitchell, appeared via Zoom at the pre-trial hearing.
Earlier, another judge had ruled under a domestic violence framework that Treviso should not see her boyfriend and alleged father of her child, Devin Fierro, who also attends the same university, reports Law & Crime.
But Judge Jane Gray expressed shock at the ruling, saying there were no domestic violence allegations in the case and ruling that Trevizo should be allowed to see Fierro and attend the same university.

Prosecutors say she killed him by strangling him, basing their theory on the fact that the baby had air in his lungs when he died.
But Treviso’s attorney, Gary Mitchell, told DailyMail.com earlier this week that she has been unfairly slandered.
Her defense team fights not only to have the charges against her dismissed, but also to prove that the boy died before she gave birth to him.
In legal files obtained by DailyMail.com, Mitchell says hospital and city employees violated HIPPA laws by sharing her medical records and discussing the case.
He also claims that by the time the case goes to court it will become clear that she did not strangle the child.
“The fact is, she didn’t kill her baby. The tests (that have been done) to determine if she did are so outdated it’s medieval.
“There was no strangulation. This is not a murder case,” he said.
Mitchell says he will show how Alexee was given a cocktail of drugs unsuitable for pregnant women, let alone women in labor.
“This was certainly the primary cause of the baby’s death. Guess what causes major breathing problems in fetuses? Morphine,’ he said.
Mitchell says a toxicology report shows the baby had 0.19 nanograms of morphine in his system when he was born, and that he also tested positive for COVID-19, influenza A&B and SARS.
He claims that Alexee was unaware she was pregnant despite gaining weight and developing a bump that was clearly visible through her cheerleading attire.
“You know, women will say to me, ‘She put on 10 or 15 pounds, so she must have known,’ but she was on her period when she went to the hospital.”
“Scientifically, 1 in 2,500 women don’t know they’re pregnant when they give birth, especially teenagers.
“She used to go to McDonald’s with her boyfriend every day. She thinks that gaining weight is normal. She was on birth control and had her period. She didn’t feel kicked, she didn’t feel sick.
“Why would she think she was pregnant?”

However, as DailyMail.com previously reported, Trevizo’s high school friends claimed she knew she was pregnant.
The friends claimed that Trevizo even picked a name for the baby boy. She would call him Alex.
And she claimed that she had gained weight not because she was pregnant, but because she had started taking the contraceptive pill.
Trevizo was photographed in her cheerleading outfit with a visible baby bump just three weeks before she gave birth.
Just 21 days later, she was in hospital, crying when police told her she had been caught trying to dispose of her son’s body.
Meanwhile, Mitchell says the staff inadvertently continued to give Alexee drugs that would impair the baby’s breathing for too long.
She goes to the hospital on January 26 and arrives at 12:03. She is admitted at 12:05 pm. At 12:18 they start giving her muscle relaxants.
“At 12:28 they give her morphine, and they also give her more pain meds. That goes on for 111 minutes.
‘They give her ketorolac, which you shouldn’t give to pregnant women, and ondansetron for nausea.
‘They give her Cyclobenzaprine, a muscle relaxant, paracetamol and morphine, and you are absolutely not supposed to give that during labour.
‘At 12:28 she’s getting morphine and bloodwork. At 12:51 they knew she was pregnant.
“She enters the bathroom at 1:39 am. They had removed the IV so she could go to the toilet.’
Prosecutors say Alexee knew she was pregnant but was desperate to hide it from everyone.
After giving birth in the bathroom, she placed the baby in a garbage can and covered it in a garbage bag.
The child was discovered by a hospital cleaner who was traumatized by what she found.
