Migrants find LOOPHOLE in Biden border policy: Venezuelan says he entered US after blaming ‘technical difficulties’ as DHS prepares to DOUBLE monthly asylum appointments
- Several dozen migrants exploit a loophole in the CBP One app that allows them to bypass making an appointment online
- Is because Biden has increased the number of monthly asylum appointments at the border – from 20,000 a month to about 40,000
- Border continues to be a problem and has become a center of the 2024 race
Migrants found a loophole in Joe Biden’s CBP One app that allows them to bypass the requirement to make an online appointment for an asylum interview.
The new Department of Homeland Security policy created under a program implemented by Secretary Alejandro Mayorkas and President Joe Biden requires migrants to make an appointment online to have their asylum applications processed.
But several dozen migrants found in the fine print that people with “language barriers, illiteracy or technical difficulties” can instead show up in person to request an interview.
“I tried many times to arrange an interview on the app, but it never worked out,” says Venezuelan migrant Cesar Segura told Border Report last week.
Meanwhile, despite this loophole, the Biden administration plans to dramatically expand the asylum-seeking process at the U.S.-Mexico border to nearly double the number of people entering the country.
Presidential candidate Ron DeSantis made an impromptu visit to the Arizona border on Wednesday, where he previewed a new coalition of governors and sheriffs to fight the migration crisis.

He helped transport Texas migrants to California, left them outside a church in Sacramento, and prompted the Democratic administration’s Gavin Newsom to investigate and charge his Florida counterpart with “state-sponsored kidnapping.”
Starting this month, the US will allow about 40,000 migrants into the country each month at ports of entry along the border. DHS told CBS News.
Previously, the number of migrants making asylum appointments through the CBP One app was 20,000 per month – but now 1,250 appointments will be granted each day to allow migrants to gain entry and apply for asylum.
The Biden administration wants CBP One to become the main way for migrants to seek asylum in the US
Unveiled by Biden in January, CBP One is designed to discourage migrants from illegally entering the US between ports of entry — and instead come to legal entry points to seek legal asylum.
But Segura and other migrants have found that they don’t have to go through this application if they just claim they had technical difficulties or couldn’t understand the process.

On Monday, Segura walked up to Customs and Border Protection (CBP) officers at the port of entry in San Ysidro to request an appointment as the number of migrants at his port of entry has grown to 400 over the past week.
Dozens of other migrants had the same idea.
“It was our trump card to play,” Segura told Border Report in Spanish. “I want to pinch myself to make sure this is really happening.”
The migrant has queued for ‘four cold nights’, waiting to speak to CBP agents and be allowed into the US
Segura was allowed into the country and flies to Miami to meet his sponsor. The Venezuelan migrant is not due to appear before the asylum court until June 26, 2026, which means he can live in the US undocumented for at least three years.
