Manhattan court hearing slated ahead of Harvey Weinstein’s retrial in New York

NEW YORK — NEW YORK (AP) — Harvey Weinstein is expected to appear in court in New York ahead of his scheduled retrial on rape and sexual assault charges.

The disgraced Hollywood mogul is scheduled to attend a preliminary hearing in Manhattan Criminal Court on Tuesday. His retrial is tentatively scheduled for sometime after Labor Day.

Weinstein’s attorney Arthur Aidala and spokespeople for Manhattan District Attorney Alvin Bragg declined to comment on the topics that will be discussed at the hearing.

During the last hearing in May, prosecutors told Judge Curtis Farber that they are evaluating more allegations of sexual misconduct against Weinstein and may seek to file new charges against him.

According to Assistant District Attorney Nicole Blumberg, additional people have come forward with complaints of abuse and prosecutors are currently assessing which ones fall under the statute of limitations.

She said some potential survivors who were unwilling to come forward during Weinstein’s first trial in New York may now be willing to testify.

Aidala said he was confident that no additional prosecutors would be found to bolster the prosecution’s case.

Weinstein, 72, has maintained that all sexual activity was consensual. He is currently incarcerated at Rikers Island Jail, but has suffered from medical problems during his time behind bars.

In April, The New York Supreme Court dismissed the case Weinstein was convicted of rape after a trial judge improperly admitted testimony against him based on allegations from other women who were not part of the case.

The ruling reopened a painful chapter in America’s reckoning with sexual misconduct by powerful figures. The #MeToo era began in 2017 with a flood of allegations against Weinstein.

Weinstein, who was serving a 23-year prison sentence in New York, was also convicted in Los Angeles in 2022 of another rape and is still sentenced to 16 years in prison in California. But in a appeal filed last month In the Second District Court of Appeals in California, Weinstein’s lawyers argued that he did not receive a fair trial in Los Angeles.
