German prosecutors refuse to hand over Madeleine McCann case file to lawyers representing prime suspect Christian Brueckner

  • He is currently on trial for five sexual offenses unrelated to Madeleine’s case

Prosecutors are refusing to hand over paperwork related to their investigation into Madeleine McCann to lawyers representing the prime suspect.

Convicted rapist and pedophile Christian Brueckner, 47, is currently on trial accused of five separate sex crimes that allegedly occurred in the area where Madeleine disappeared in 2007.

Four years ago, prosecutors in Germany sensationally named Brueckner as the person they believe responsible for Madeleine’s “kidnapping and murder,” but so far he has not been charged in connection with her disappearance.

It has led to growing speculation that despite claims that they have proof, there is no hard concrete evidence to incriminate him, and he has always denied any involvement.

Before the start of his current trial in Braunschweig, Germany, Brueckner told MailOnline that the accusations against him were “ridiculous” and added that he hoped “they would find out the truth.”

It has now emerged that his defense team led by Friedrich Fulscher has reclaimed the case file on Madeleine, who disappeared from the seaside resort of Praia da Luz in Portugal’s Algarve when she was just three.

However, prosecutor’s spokesman Hans Christian Wolters told MailOnline that they “wouldn’t give it to him”, adding: “He is not entitled to it at the moment,” and he refused to be involved if ever charges would be filed against Brueckner.

As his current trial began, Mr. Fulscher said Brueckner was continually linked by prosecutors to Madeleine’s disappearance and that he repeated this “like a prayer wheel.”

He added: ‘The results of the investigation have not yet been presented to the defense, so the suspect has not been able to substantiate this claim.

“A similar media campaign of prejudice has been sought in vain.”

Defense attorneys say they want access to the file to defend Brueckner in his current trial and have also asked for it to be deleted.

He is currently accused of three rapes and two sexual assaults that allegedly took place in the Algarve between 2000 and 2017, when he lived and worked there.

At the latest hearing, former friend Christian Post told the court that Brueckner had confessed to him that he was an expert in ‘breaking and entering’ holiday apartments and hotels.

Post, 56, added that Brueckner told him he was good at “bringing stuff” and had helped himself to dozens of holidaymaker passports which he resold to make money.

Madeleine was snatched from her room while her parents Kate and Gerry were out for dinner with friends, but her two siblings were left alone.

Philip Marquort, member of Brueckner’s legal team, said: ‘The BKA maintains only one file for all investigations and specifically channels individual results into various proceedings against our client.

‘The right to a fair trial, they state in the most recent evidence request, requires access to all files.’
