Kmart is dealt brutal blow in bitter legal fight with customer over $625,000 payout after she was injured at one of its stores

A Kmart customer has won a huge compensation award against the retail giant after a mountain bike fell on her in a store.

Rita Marmara, 64, was injured at the self-checkouts at the Kmart store in Woy Woy, on the NSW Central Coast, in September 2018 when a large box containing a mountain bike fell on her from behind.

The grandmother, from Sydney, took Kmart to the NSW District Court, where she sought $743,971 in damages to cover medical bills and lost income.

She told the court she had undergone two operations after the incident and could no longer continue working at a retirement home due to her neck and shoulder pain.

On Tuesday, the NSW Supreme Court dismissed Kmart’s appeal and ordered the store to pay Ms Marmara $624,775.60 plus costs.
