The family of Jordan Neely, the homeless Michael Jackson impersonator who was killed after being placed in a stranglehold by Daniel Penny, has stated its intention to file a wrongful death lawsuit against the Marine veteran.
Neely’s aunt, Carolyn, announced the intention in a letter sent to Penny’s attorney by her attorneys, Manhattan-based Mills & Edwards.
‘ Please note that this office has been retained . . . to file a claim for personal injury and wrongful death. . . . Your action resulted in the death of Jordan Neely,” the letter reads in sub-reports the New York Post.
The May 1 confrontation was captured on video showing Penny restraining Neely with the help of two other passengers, after Neely allegedly yelled threats and threatened people on the train.
According to the Post report, Neely’s aunt is also looking for Penny’s insurance information.

At the time of writing, Daniel Penny’s legal defense fund on conservative fundraising site GiveSendGo has reached $2.8 million.
“Funds are being raised to pay for Mr. Penny’s legal fees incurred for any criminal charges and any future civil suits that may arise, as well as costs associated with his defense,” the page reads in part.
The largest contributor to Penny’s cause is right-wing commentator Tim Pool, who contributed $20,000. Republican presidential nominee Vivek Ramaswamy donated $10,000 and conservative rocker Kid Rock donated $5,000.
Rock wrote on the page, “Mr. Penny is a hero. Alvin Bragg is a point of sale. kidrock.’
Meanwhile, a GoFundMe fundraiser for Jordan Neely’s family, set up by his aunt, Carolyn, has raised $150,000. That money will go towards Neely’s funeral, burial and the public viewing which was held on May 15.
