The apparent headline was intended as the Justice Department report clearing Biden of mishandling classified documents.
But the real headline was contained in special counsel Robert Hur’s reasoning.
He wrote that a jury is unlikely to convict because Biden, 81, is “a likeable, well-meaning, older man with a poor memory” and suffers from “diminished faculties in old age.”
Biden told investigators he could not remember when his term as vice president ended. “If it was 2013, when did I quit as vice president?” he asked.

On the second day of his interview with prosecutors, he could not remember when his term as vice president began: “Am I still vice president in 2009?”
And he couldn’t remember when his son Beau died. Not even within a period of years.
If this were a Republican president, the articles of impeachment would have been drafted long ago. The 25th Amendment would have been invoked. The op-eds calling for his resignation are said to be brutal.
Where are the patriots in the Democratic party? Where are the Obamas and the Clintons to save us from Joe Biden?
You can’t be too handicapped to prosecute, yet sharp enough to be President of the United States.
Finally, it looks like the Democrats are waking up. Party insiders told DailyMail.com that ‘now is panic time’ and ‘we will see more and more Democrats saying the quiet part out loud’.
“It’s a nightmare,” a Democratic House member told NBC News.
After Biden’s press aide, New York Times columnist and Trump foe Maggie Haberman posted, “Several Democratic operatives sent panicked texts about how that press conference went.”
The United States could take a cue from Britain, which relies on the so-called “men in gray suits,” a coalition of politicians who, behind closed doors, quietly tell a politician when it’s time to go.
We could also demand age limits. You cannot run for president of the United States until you are 35 years old. Why not limit the age too?
Age limits would have saved us not only from the catastrophe of Biden, but also from Donald Trump, who has recently shown signs of his own cognitive problems.
But then again, it’s Trump Derangement Syndrome that got us here. We have been told time and time again that Biden is the only person who can beat Trump.
Not so. In fact, Old Joe is the only person who can ensure a Trump victory after this unmitigated disaster.
He looked and sounded frail, frail and confused. He had no control over the room. He looked at the podium as reporters shouted over each other, his posture tired and overwhelmed.
He answered a question about the Israeli hostage crisis in fits and starts, like a rusty car engine struggling to turn over: “I believe, as you know… that the behavior of the response… in the Gaza Strip. .. , er…’ – here he took a long pause – ‘exaggerated.’

Worse, he said he had spoken to “President Sisi” – the leader of Egypt – about opening humanitarian aid to Gaza, but referred to him as “the president of Mexico.”
Our enemies are watching it. Is it a coincidence that Hamas, Iran, the Houthis, Russia, China and North Korea are so emboldened?
Joe Biden is a walking, talking crisis.
He tried to debunk the report’s devastating finding that he could not remember when Beau died.
“How on earth does he dare bring that up?” Biden growled.
In fairness to Hur, Biden talks about Beau’s death always. It has become the fabric of his political story. It’s fair game.
“Let me tell you something,” Biden continued. ‘Every day since the day he died, I have worn the rosary he received from Our Lady of…’
And here Biden was visibly blank, waving one hand in front of his face as he tugged at the rosary on his wrist.
‘I don’t need anyone, I don’t need anyone to remind me of his death. When he died’.
That’s not the point. Joe Biden can no longer hide behind his personal tragedies. The stakes are too high.
Unless Thursday night’s press conference was an internal coup attempt, plenty of people in Biden’s inner circle liked the idea — in a week when the president announced on two separate days that he had spoken to dead heads of state.
The media en masse should be on fire. Yet his defenders on the left outdid themselves on Thursday night, displaying an embarrassing level of apologetics and intellectual dishonesty. We’ll come back to that in a moment.
Here’s how you can see that the DOJ report is right: The White House press pool, having ignored this elephant in the room for years, went after Biden with ferocity.
“How bad is your memory and can you continue as president?” asked a journalist.
“Do you think your memory has gotten worse, Mr. President?” said another.
A female reporter: ‘Many American people have been watching and expressing concern about your age…’
“That’s YOUR judgment,” Biden shot back, his voice full of anger. ‘That is YOUR judgement. That is not the opinion of the press’.
But it is the judgment of the electorate. The latest national poll from NBC News found that as many as 76 percent of voters are concerned about Biden’s mental and physical ability to serve.
It’s the Trump Derangement Syndrome that got us here. We have been told time and time again that Biden is the only person who can beat Trump. Not so. In fact, Old Joe is the only person who can ensure a Trump victory after this unmitigated disaster.
Yet here were Biden’s cheerleaders on Rachel Maddow’s MSNBC show, a veritable mastermind making all sorts of accusations and excuses and shaming the special counsel for doing his job — for saying what we all know to be true. What we all just saw with our own eyes during that press conference.
‘What does the word ‘elderly’ do there?’ asked fellow host Lawrence O’Donnell. “Uh… ‘bad memory’ — what’s the test for that?”
Is he joking?!?
Ari Melber, MSNBC’s chief legal correspondent: “Legally, there is no interest or relevance (to Biden’s knowledge),” he said. ‘If it concerns very specific mental criminal intentions or gentlemen r… Certainly.’
Except the special counsel said in his finding that Biden had “poor memory.” precisely the reason for not filing charges. To quote the report:
“It would be difficult to convince a jury that they should convict him – by then a former president well into his 80s – of a serious crime requiring some form of courage.”
Another heavy load, courtesy of the network’s Chris Hayes: “There was one adverb that just struck me,” he said — referring to the description of Biden as “painfully” slow.
“I just thought, who’s in pain?… That adverb has the siren jumping off the page.”
Well, yes. And rational Americans are complying.
Now on to Joy Reid’s embarrassment: “It’s nasty and snarky for no reason.”
No reason! I think national security now falls under the umbrella of details at MSNBC.
Remember: Maddow and co. – and her ilk at the New York Times – consider themselves the smartest people in the room. Smarter than us, and certainly smarter than Democratic party insiders who have begun to openly admit that Biden needs to go.
Now the urgency is finally clear. If Biden will not step aside, the party should impeach him immediately.
Anything less is not only unpatriotic, it is dangerous.
