Italian father fights to stay in Victoria: Andrea Tindiani faces deportation and the prospect of leaving his Australian-born nine-year-old son Marley behind

A heartbroken father fights to stay in Australia to care for his son as he faces eviction after his work sponsorship is abruptly ended.
Andrea Tindiani, 37, moved abroad from Italy on a working holiday visa in 2012 before receiving sponsorship from his employer in Victoria the following year.
The 37-year-old had his son Marley, who is now nine years old, in 2014 before splitting with the child’s mother, Emily.
Mr Tindiani was laid off in 2016 due to a restructuring in his company and quickly went through a cycle of student visas until 2021 when he unsuccessfully applied for a confirmatory residency visa.
After calling Victoria home for the past 11 years, he has no choice but to do so faces the Administrative Appeal Tribunal as he fights to stay with his family.

“It is with a heavy heart that I reach out to inform you that last week the Tribunal REFUSED to grant me a confirmatory residence visa,” the distraught father shared on Facebook on Aug. 4.
“Despite living here for 11 years, supporting thousands of Australian men on their transformation journey, being an incredibly dedicated father to my son Marley, a wonderful ex-partner and a good member of my community.”
Local Bendigo wrote that there is one last hope, with the Tribunal recommending Immigration Secretary Andrew Giles consider his case on a compassionate basis.
Mr. Tindiani told A current situation no other visas were available to him.
“I have worked hard to build a secure future for my son and our family,” he wrote in a petition.
“During this time, I have gone to great lengths, both financially and emotionally, to navigate the complexities of temporary visas and make sacrifices to be present for Marley despite the uncertainties and obstacles.”
“My son, Marley, deserves his father by his side. I understand the great importance of this, because I myself grew up without a father.’

“Marley should not have to go through the trauma, hardship and heartache of losing his father,” said Mr. Tindiani.
The Italian-born father has maintained a friendly relationship with Marley’s mother and is actively involved in all aspects of parenting, including picking up his son from school and caring for him.
Mr Tindiani’s case has been forwarded to the Immigration Minister who will decide the fate of this family.
He launched an online petition, which has already attracted more than 14,000 signatures and raised more than $6,000.
“As a young boy I missed a male role model,” he said in his petition.
“As a mature adult, I understand the negative impact it had on me and what it took to conceive myself.
“I don’t want my son to needlessly go through similar hardships. I want to be there for him.’
