Indian migrant is kicked out of Australia for having a sex with a 12-year-old girl he met at Kmart – after claiming he thought she was 18 and married

A migrant who had sex with a 12-year-old girl he claimed was a married 18-year-old is being sent back to India.

The 33-year-old – whose name has been withheld – was jailed for 10 months in February last year after admitting to six sex offences on the night he met the girl in April 2021, the Mercury reported.

The man pleaded guilty to five counts of penetrative sexual abuse of a child or young person and one count of sexual assault.

The sex offender’s visa was revoked in August of last year. The case was brought up again last week at a hearing at the Administrative Appeals Board.

The court heard the man met the girl through the dating app Grindr, before picking her up from a Kmart in Hobart, Tasmania.

When he arrived to pick up the girl at 2am, the man claimed he found the woman talking to another man, who she identified as her husband.

He claims she also told him he was a prostitute, which gave him confidence that she was past the age of sexual intercourse.

“I knew you had to be 18 to get married,” the man told the court.

“Unfortunately, this happened… I had no intention of harming a child. I was purely looking for an adult. There was no criminal intent.”

The court found it “difficult to accept” that the man had not noticed the girl’s young age when he saw her naked body in a bedroom.

The court ruled that despite the man being unlikely to reoffend, he should be deported due to the seriousness of his crimes.
