An illegal migrant accused of raping a child under the age of 16 in Massachusetts was ultimately arrested by immigration authorities after a local court ignored a request to detain him.

The Boston ERO (Office of Enforcement and Removal Operations) has often been critical of the state’s various liberal municipalities for allowing migrants convicted of heinous crimes to go free despite their requests to detain them amid a of the largest migrant crises in American history.

The unnamed 20-year-old, a Brazilian citizen, was arrested by Border Patrol on July 28, 2021, after he and his mother illegally entered the US near San Luis, Arizona.

They were ordered to appear before a DOJ immigration judge before being released on recognizance.

Even before his horrific child molestation accusation, he had run into more trouble with the law after arriving in Massachusetts. He was arrested in August 2023 for operating a motor vehicle without a license. Those charges were later dismissed.

According to ERO Boston, a warrant was issued for his arrest in December in the town of Milford for rape of a child and enticement of a child under the age of 16.

He was eventually found and arrested on January 10, 2024, in Portland, Maine, about 140 miles north. In addition to the rape charge, he was accused of being a fugitive from justice.

The man, who has not been named by immigration officials, was brought into Milford District Court on January 18, where he was arraigned on the charges and bail was set at just $5,000, although he would have to wear a GPS monitor have to wear.

ERO Boston requested that he remain in jail, but the court ignored this and released the accused child molester after he posted bail.

He was eventually arrested again on March 28 near his residence in the city of Lowell.

“This Brazilian non-citizen is accused of sexually abusing a Massachusetts minor,” Todd M. Lyons, director of the ERO Boston Field Office, said in a statement.

“Every second he walks freely in our communities, he represents a potential threat to the children of our communities.”

“The men and women of ERO Boston will always prioritize public safety by protecting the residents of New England from egregious non-citizen offenders,” Lyons added.

According to data from the Emergency Response Team, officers made 170,590 arrests in 2023, an increase of 19.5 percent compared to the previous year.

The agency recorded the arrests of 73,822 non-US citizens with criminal histories; 108 were fugitives wanted by their governments for crimes such as murder, rape, terrorism and kidnapping.
