Illegal immigrant convicted of rape is rearrested by ICE agents after judge sentenced him to just 190 days in jail

A Guatemalan immigrant convicted of raping a Maryland resident last month was arrested yesterday by Immigration & Customs Enforcement officers.

Guatemalan Henry Argueta-Tobar, 19, was arrested after being sentenced to 20 years in prison on July 3 for second-degree rape.

The court subsequently suspended the entire prison sentence, except for 190 days.

According to an ICE press release, the young man was arrested by the Charles County Sheriff’s Office in December 2023 and charged with second-degree rape.

ERO subsequently issued an immigration hold against him at the Charles County Detention Center in La Plata.

According to ICE, an immigration detainer is a request for state or local law enforcement authorities to hold an individual who is about to be released from custody so that ERO can “assume custody for removal purposes in accordance with federal law.”

However, this request was not honored by the Charles Country Detention Center, meaning Argueta-Tobar was released.

According to an ICE press release, the 19-year-old was first arrested in May 2019 after illegally entering the U.S. as an accompanied minor near El Paso, Texas.

The U.S. Border Patrol transferred custody of Argueta-Tobar to ERO El Paso, which released him on a recognizance warrant.

In February, a Justice Department immigration judge in Baltimore ordered the man to be deported to Guatemala before he was convicted of rape in July.

Argueta-Tobar remains in custody following his arrest yesterday.

According to the report, Biden has allowed 90 percent of migrants placed in the Family Expedited Removal Management (FERM) program to remain in the U.S. instead of being deported.

Only 2,600 of the 24,000 migrants who signed up for the program have actually been deported, according to a New York Post report. That leaves more than 21,000 who were allowed to remain in the U.S.

Since FERM began in May 2023, more than 840,000 migrants traveling with family units have been apprehended by authorities at the border, according to ICE data reviewed by the House Committee on Homeland Security.

This means that only a fraction of the illegal immigrants who came to the US with their families were deported through the FERM program.

It was not immediately clear why not all family members were immediately placed in the FERM deportation procedure.

The flawed program is now attracting the attention of key lawmakers in Congress, who are demanding action.

“The same White House that lets millions of illegal immigrants into our country also refuses to deport them,” Republican House Speaker Mike Johnson posted on X in response to the shocking report.

“The Biden-Harris administration has no intention of enforcing our laws. No amount of spin can cover this up.”
