Hunter Biden’s lawyer claims gun charges WON’T make it to trial and slams prosecutors for ‘bending’ to political pressure – but dodges question on if president’s son lied about being on drugs

Hunter Biden’s attorney argued Friday that the case against President Joe Biden’s son won’t make it to trial — but declined to say whether or not Hunter was on drugs when he bought the gun that led to federal charges.

Attorney Abbe Lowell told ABC’s Good Morning America that the Justice Department bowed to “political pressure” from Republicans in Congress when it charged Hunter Biden with three felonies for lying about his crack cocaine addiction while buying a weapon in 2018.

The president’s son now faces up to 25 years in prison, but his lawyer has insisted the case will be ‘dismissed’ before Hunter faces trial.

‘The US attorney’s office has known about this for years. No charges,” Lowell said. ‘What changed? Not the facts, not the law, but all the politics that are now playing a role.’

“The only thing that has changed is the political pressure exerted by Republicans in Congress and the media that support them,” he argued.

The indictment accuses Hunter Biden in two counts of filling out a form indicating he was not using illegal drugs when he purchased a Colt Cobra revolver in October 2018. The third charge alleges he possessed a firearm while taking a narcotic.

Lowell said Hunter was not using drugs when he purchased the revolver.

“If you want to be specific, be specific. If the form asks if you are a drug user on the day you purchase a gun, that’s a problem. If it says: have you ever used drugs, then that is a problem. That will be played out in court,” he said.

ABC’s George Stephanopoulos asked him if the defense would argue that Hunter “wasn’t a drug user on the day he signed the form?”

“No, our defense is multi-part,” Lowell replied. He also argued: ‘I think the case will be dismissed before trial.’

Hunter Biden detailed his drug use in his memoir, including smoking crack cocaine. The first son told how he relapsed into his addiction after his brother Beau died of brain cancer in 2015.

Video discovered on Hunter’s laptop shows him naked and brandishing a gun in a hotel room in 2018, reportedly five days after he purchased the gun.

But when asked if Hunter Biden was on drugs the day he bought the gun, Lowell said, “I think this is something that, if it ever comes to that, you and everyone else will see the proof.”

He declined to be more specific.

But he went on to rage against the Justice Department for withdrawing from an earlier plea deal, accusing the FBI of caving to political pressure from Republicans in Congress, who have been investigating Hunter’s foreign business deals Biden and the Biden family finances.

US Attorney David Weiss, appointed by Donald Trump, is overseeing the prosecution and has been given special counsel status.

Attorneys for Weiss and Hunter reached a plea deal in July that called for the president’s son to plead guilty in Delaware federal court to two misdemeanor counts of failing to pay his taxes in exchange for a probation recommendation from prosecutors.

A separate weapons crime charge for illegally possessing the special Colt Cobra .38 pistol would have been dropped within two years if Biden had complied with the terms of what is known as a diversion agreement.

Lowell argued Friday that there was a deal that should have avoided federal charges. He also argued that courts now consider the statute used in the indictment to be unconstitutional.

“The law has changed,” Lowell said. “But the law did not change in the prosecutor’s favor. The law was struck down because a number of federal courts found this gun charge unconstitutional.”

The plea deal, which Republicans labeled a “sweetheart deal,” fell apart in a Delaware courtroom as the president began questioning some of its details, including one that would theoretically protect Hunter Biden from other tax-related crimes during the same period. .

Prosecutors said that would not be the case. Hunter’s lawyers said yes. The agreement fell apart. The three federal indictments were announced Thursday.

Two of the charges carry a maximum prison sentence of 10 years, while the third carries a maximum prison sentence of five years. Each count also carries a maximum fine of $250,000.

Republicans insist Biden’s son is guilty of more crimes and that Weiss’ indictment on weapons charges should be just the tip of the spear.

The White House is not commenting on the new charges for the president’s son, and Biden joked that he would be “in trouble” if he answered press questions at the end of an economic speech later Thursday.

Still, it is a crushing blow to the president, who is running for re-election next year. Hunter’s legal troubles were thought to have been resolved with the plea deal and it was shocking when the deal fell apart.

The indictment came the same week that Republicans in the House of Representatives opened a formal impeachment inquiry into President Biden over his alleged ties to Hunter’s business activities. This investigation will likely have a long-term impact on his political career.

The First Son purchased a .38 Colt Cobra pistol in Delaware, a state where every buyer must answer a series of questions before he can get his hands on a gun.

One of the 2018 applications asks whether the applicant uses drugs or is addicted to them. The box is clearly marked ‘no’.

Hunter has admitted he was addicted to crack cocaine at the time he bought the gun.

About two weeks later, Hallie Biden, the widow of his lover and brother, found it “open” in his truck and threw it in the grocery store trash. Its discovery led to a police investigation.

Additionally, current President Biden sounded close to tears in the voicemail left on Hunter’s abandoned laptop on October 15 — three days after Hunter bought the gun and lied about his drug addiction — pleading with him for help.

‘It’s Dad. I called to tell you I love you. I love you more than the whole world buddy,” Joe said in the Oct. 15 post. ‘You have to get help. I know you don’t know what to do, and neither do I.”

On July 27, White House Press Secretary Karine Jean-Pierre ruled out President Biden pardoning Hunter. But it remains to be seen whether the White House’s stance has changed now that Hunter faces the three new charges.
