The House passed legislation Thursday morning 258-169 that will guarantee federal recognition of same-sex marriage on one of the final votes with Nancy Pelosi as House speaker.
Only 39 House Republicans joined the 219 House Democrats in voting to pass the bill. One Republican representative voted ‘present’, meaning they refuse to cast a ‘yes’ or ‘no’, and four were marked as ‘no votes’.
President Joe Biden will now receive the final version of the legislation for his signing.
Pelosi hesitated and seemed to choke as she declared that the bill passed the House.
“I was excited, I’m sorry,” she said after banging her mallet on the desk several times.
The Respect for Marriage Act won the approval of the Senate last month with a vote of 61-36 and was returned to the House to adopt the changes that were made to the bill. While 12 Republicans joined 49 Democrats in supporting the bill, most Republican members of the upper house voted against the legislation.
Nancy Pelosi smacked the House Speaker’s gavel for one of the last times Thursday when she got emotional to announce that the House has adopted the final version of a bill codifying same-sex marriage across the country.
The final version of the Respect Marriage Act passed the House on Thursday morning in a vote of 258-169 after passing the Senate last month: 39 Republicans joined all Democrats in voting for its approval.
The move came due to concerns among most Democrats that the Supreme Court, with a 6-3 conservative majority, could strike down protections for same-sex couples to legally marry after overturning the landmark Roe decision. v. Wade that protected abortion at the federal level.
The ruling in Roe v. Wade sparked calls from activists to codify same-sex marriage into federal law.
The legislation, written by a bipartisan group of lawmakers, is designed to act as support for the 2015 Supreme Court decision that legalized same-sex marriage in Obergefell v. Hodges.
Allows the federal government and states to recognize same-sex and interracial marriages as long as they were legal in the states where they were performed. However, the bill would not prevent states from blocking same-sex or interracial marriages in the future if the Supreme Court rules they can.
The bill also makes concessions to religious groups and institutions that do not support same-sex marriages.
