House Oversight and Reform Committee chair Rep. Carolyn Maloney announced that it will obtain Trump financial records after the former president agreed not to appeal an appeals court ruling.

Maloney (D-N.Y.) announced the breakthrough, three years after her predecessor committee chairman asked for them, and weeks after losing her own congressional primary.

‘After numerous court victories, I am pleased that my Committee has now reached an agreement to obtain key financial documents that former President Trump fought for years to hide from Congress,’ she said in a statement.

The legal saga is so long and convoluted that Maloney released a timeline of the legal path that will give lawmakers a look at Trump’s accounting practices, which are also the subject of a civil investigation in New York.

It began in 2019 under former chair Rep. Elijah Cummings, the panel subpoenaed the documents from the Mazars accounting firm that the Trump Organization used as part of its probe of ‘unprecedented conflicts of interest, self-dealing, and foreign financial ties.’

A key part of that probe came when former Trump lawyer Michael Cohen testified before the committee that the Trump Organization pumped up valuations when seeking financing, then low-balled them when dealing with tax authorities. 

That became a key area of focus for New York AG Letitia James.

The subpoena set off a legal battle while Trump was in the White House and resisted the subpoena. It went all the way to the Supreme Court, which ruled in 2020 7-2 that a lower court must consider the separation of powers issues at play, and set up a standard requiring a legislative interest.

The D.C. Circuit Court of Appeals ruled that the latest subpoena meets that standard.

‘Under the agreement reached by the Committee, former President Trump has agreed not to further appeal the D.C. Circuit’s ruling, and Mazars USA has agreed to comply with the court’s order and produce responsive documents to the Committee as expeditiously as possible,’ according to Maloney’s office.

Trump’s lawyers filed a document with the U.S. Court of Appeals for D.C. on August 31 announcing the agreement.

‘In light of the panel’s opinion, Plaintiffs, Mazars, and the Committee reached a settlement of this case on August 30, 2022. Plaintiffs hereby withdraw their petition for rehearing en banc,’ according to the document.

Mazars USA announced in February that it was cutting ties with the Trump organization, and said it could not longer stand behind a decade’s worth of statements of financial condition for the company. 

The apparent agreement comes when Trump is marshaling his legal resources on a new front, as he faces a Justice Department investigation for removal and storage of government documents at his Florida Mar-a-Lago club.

Trump on Wednesday bashed the FBI for the way it photographed a collection of top secret documents found inside his Mar-a-Lago office.

He has been bolstering his legal team, amid speculation that some of his lawyers might be fact witnesses in the case, with one having signed a document attesting to a ‘diligent search’ for classified information at Mar-a-Lago.
