He broke down several times when he appeared at the Joondalup Magistrates Court in Western Australia on Tuesday, where he faced various charges.
The court heard that she was “clearly unable to breathe” and that she later sent the video to her ex, who is the child’s father, and to her grandmother. Western Australian reported.
He allegedly sent the video along with several more abusive messages threatening to harm his son.
The court was told that Maxwell also sent another video showing his son in a car seat and his hand around his throat.
Prosecutors allege the boy was screaming in pain during the video.
His grandmother contacted the police and the baby was taken from Maxwell and rushed to the child protection unit at Perth Children’s Hospital.
The baby’s condition is currently unknown.
His mother has been charged with two counts of impeding another person’s normal breathing or blood circulation by applying pressure to their neck, one count of impeding another person’s normal breathing or blood circulation by covering their nose, and one count of threatening of death.
Police allege the crimes occurred between June last year and this month.
Judge Kelly Thompson said Maxwell faces “very serious charges” for the alleged abuse of her son.
However, he told the court that Maxwell needed help with his mental health.
His grandmother contacted the police and the baby was taken from Maxwell and rushed to the child protection unit at Perth Children’s Hospital.
During her court hearing, Maxwell asked when she would be able to see her baby again and if she would ever get full custody again.
“I was begging (her ex-partner) to help me,” she said through tears.
‘I do not know what to do.’
Prosecutors strongly rejected bail, however the magistrate granted it under strict conditions.
Maxwell is not allowed to have contact with his son, he cannot go near his ex-partner’s house and he has to have supervised visits with other children.
She is due to appear again at the Joondalup Magistrates Court on Friday, January 20.
