Hilaria Baldwin has been seen for the first time since prosecutors tried to retry her husband Alec Baldwin’s manslaughter case in Rust.

The 40-year-old yoga teacher looked tense during a solo coffee break in New York City on Thursday.

Wearing a white tank top and black sweatpants, she held a drink in one hand and brushed back her hair with the other.

The mother of seven kept a low profile on the street, wearing dark designer sunglasses.

The revelation comes after a prosecutor asked a New Mexico judge to reconsider Alec’s involuntary manslaughter charge in the 2021 fatal shooting of cameraman Halyna Hutchins on the Rust set, according to a court document released Wednesday.

Special prosecutor Kari Morrissey argued that the July decision lacked a sufficient factual basis and did not violate Baldwin’s right to a fair trial.

U.S. District Court Judge Mary Marlowe Sommer had already dismissed the case midway through the trial, saying police and prosecutors had withheld evidence for Baldwin’s defense in the shooting that killed Hutchins.

The dismissal was with prejudice, meaning the charge cannot be refiled after any appeals have been resolved.

Baldwin, the lead actor in Rust, was rehearsing a scene when the gun he was holding went off, fatally striking camerawoman Halyna Hutchins and wounding director Joel Souza.

The 30 Rock star claims he pulled the hammer back but did not pull the trigger before the revolver went off.

The case revolved around ammunition brought to the sheriff’s office in March by a man who claimed it may have been connected to Hutchins’ death.

The prosecution dismissed the ammunition as irrelevant, while Baldwin’s legal team accused them of hiding it, leading to a successful motion to dismiss the case.

In her request for reconsideration, special counsel Morrissey argued that the undisclosed ammunition was irrelevant and that she was focusing on Baldwin’s responsibility to follow gun safety rules.

“No one in the prosecution ever intentionally withheld evidence from the defendant. It simply did not occur to the prosecution that the bullets were relevant to the case, even though they were the same or similar to the bullets found on the set of Rust,” Morrissey wrote, citing court documents.

She alleged that defense attorneys were aware of the ammunition but chose to pass up the opportunity to examine it before trial.

“This is a smokescreen erected by the defense with the intent to influence and confuse the court … and it succeeded,” Morrissey wrote.

Baldwin’s attorney, Luke Nikas, said a response will be filed with the court.

Rust gun maker Hannah Guttierez-Reed has been sentenced to 18 months in prison for the involuntary manslaughter of cameraman Halyna Hutchins

In April of this year, Hannah Guttierez-Reed, the gunsmith on the set, was convicted of involuntary manslaughter in connection with Hutchins’ death and sentenced to 18 months in prison.

She is currently serving her sentence in the Santa Fe County Adult Detention Facility and was scheduled to testify in Baldwin’s case.

Since filming resumed in 2021, Rust has resumed filming but moved to Montana under an agreement with Hutchins’ husband, Matthew Hutchins, who named him executive producer.

The completed film is not yet available to the public.
