A judge has referred to “her penis” in a mind-boggling ruling in the case of a convicted child molester who was born male but identifies as female.

Kahdir Kamoun exposed himself to a boy, 14, on February 18, 2021, at a Centro shopping center in Bankstown, south-west Sydney, resulting in Kamoun being convicted of intentionally committing sexual acts with a child under the age of 16.

In a published verdict upholding Kamoun’s two-year prison sentence, Judge Alister Adadee describes the predator variously as “she” and “her,” as well as “he,” “him,” and “herself.” The judge also speaks of ‘her penis’.

At several points, the judgment switches between different gender pronouns to describe Kamoun, who is incarcerated in a male-only prison.

What crime did Kahdir Kamoun commit?

In October 2022, Kahdir Kamoun pleaded guilty to charges related to an incident on February 18, 2021, between 7:30 pm and 8:00 pm at Bankstown Centro mall.

According to the verdict, Kamoun bared “her penis” in front of the victim, who was drying his hands on a sink after using the toilet.

Kamoun then “grabbed” the victim’s hand and moved it towards her.

The victim fled and alerted a family member before police were called.

Kamoun was charged with intentionally inciting a child under the age of 16 to sexually touch a person.

Kamoun was sentenced to two years in prison in December 2022 and that sentence was upheld on appeal on April 23.

“Get a load of this piece and I quote…” The victim saw the perpetrator’s pants partially down and her penis was exposed. Her penis?’ asked Fordham.

These are two words that you don’t often see side by side. In the verdict we read twice about ‘her penis’.’

The verdict also referred to Kamoun continuing to “masturbate her bare penis” during the attack.

Fordham said he liked to respect people’s pronouns, but berated the court for not being able to “make a decision.”

“I can’t understand why we have to suspend biological reality in an official verdict on a child molester,” Fordham said.

“A child’s safety was shattered by a larva that preyed on him in a mall bathroom. Courts are supposed to rule on facts.

“The law is meant to be black and white, so why did the NSW District Court create a puzzle of pronouns when dealing with this sex offender?”

Judge Abadee’s verdict upheld the decision of December 22, 2022 in Bankstown Court, in which magistrate Walsh sentenced Kamoun to two years in prison.

Criminal defense attorney Sam Macedone described Judge Abadee’s verdict as “pretty hard to read.”

“You wonder why we switch from one gender to the other when perhaps the judge should have used neutral terms like ‘the perpetrator’,” he said.

Kahdir Kamoun was found guilty and sentenced to two years in prison over the incident, where she exposed herself to the boy in the toilets of the Centro shopping center in Bankstown in February 2021.

Fordham suggested that even using the accepted term “she” would have been less confusing than calling Kamoun both “he” and “her.”

Due to “other unrelated crimes,” Fordham said Kamoun will spend just under four years in prison.

Mr Adadee, a former lecturer at the University of Sydney and an experienced barrister, was sworn in as a District Court Judge in February 2019.
