The Delhi High Court on Thursday refused to stay the deportation notice issued to expelled TMC Lok Sabha member Mahua Moitra, asking her to vacate her government building.
Justice Girish Kathpalia said no specific rule has been filed before the court that would deal with the eviction of MPs from government offices after they cease to be MPs.
Finally, in view of the pending issue of eviction of the petitioner (Moitra) before the Supreme Court and the issue of extension of time to vacate the government building which is inextricably linked thereto, coupled with the fact that the petitioner was not at that time right, this Court is not inclined at this stage to invoke jurisdiction under Article 226 of the Constitution of India to restrain the execution of the impugned deportation order. Accordingly, the application is dismissed,” the court said in its detailed order.
The court has listed the Trinamool Congress leader’s petition challenging the eviction order of the Directorate of Estates for further hearing on January 24.
Earlier in the day, Moitra moved the Supreme Court to restrain authorities from evicting her from the government bungalow after her allotment was canceled following her eviction on medical grounds.
The DoE opposed the plea, saying there was no mention of any medical or humanitarian condition in its statement to the authorities.
