Harvey Weinstein’s sentencing in Los Angeles has been delayed while his lawyers seek a new trial.
The disgraced movie mogul was found guilty of rape and other sexual assault charges in December.
It was his second sentence; he was found guilty of rape and sexual assault in February 2020.
Weinstein, 70, is currently serving a 23-year prison sentence in New York. His lawyers are appealing that sentence.
Weinstein is represented in Los Angeles County court today in a wheelchair. His sentencing has been postponed until February while his lawyers seek a new trial.
In a second challenge to the courts, his lawyers are now also seeking a new trial in California.
His intent to file that request is what has delayed Weinstein’s second sentencing. He faces 18 years in prison for the charges for which he was convicted.
Weinstein, who has always pleaded not guilty to all charges, was convicted on December 19 of forcible rape, forced oral intercourse and sexual penetration with a foreign object of a woman identified in court as Jane Doe #1.
The trial heard graphic descriptions of encounters between the once-powerful producer and women trying to make their way in the world of cinema.
Prosecutors painted a picture of a predatory ogre, who for years used his professional weight to rape and abuse women with impunity.
His victims were left terrified and fearful for their careers if they spoke out against a man who ruled Tinseltown, prosecutors said.
Although he was convicted in the Los Angeles case of assaulting a woman, the jury acquitted him of sexual assault involving a second woman.

They did not reach a verdict on charges related to the alleged assaults on two other women, one of whom was identified by their lawyers as Jennifer Siebel Newsom, the now wife of California Gov. Gavin Newsom.
A hearing on a defense motion for a new trial was scheduled for February 23.
Judge Lisa Lench said Monday that if the motion is denied, sentencing will take place that day.
Last June in New York, Weinstein lost his first appeal against his verdict and sentence in the state’s intermediate appeals court.
But he has also appealed to the New York Superior Court of Appeals.
Rumors about Weinstein’s behavior had circulated in Hollywood for years, but his position at the top of the industry meant few were prepared to challenge him.
That all changed in 2017 with the release of explosive allegations against her, ushering in the #MeToo movement and opening the floodgates for women to speak out against sexual violence in the workplace.
Since then, dozens of women have claimed they fell victim to Weinstein’s predatory behavior.
