Halle Berry wins court battle over co-parenting therapy with ex Olivier Martinez amid bitter custody row

Halle Berry scored a victory in court in her battle against co-parenting therapy with ex Olivier Martinez.

The Monster’s Ball star, 58, is in an ongoing bitter custody battle with ex-husband Olivier, 58, over co-parenting their son Maceo, 11.

And now a judge has sided with the actress after Halle claimed the French actor tried to take time off from their co-parenting therapy and requested that he be required to attend.

The judge agreed with Halle in legal documents obtained by TMZbut noted that Olivier had already complied with her request after she took him to court.

The judge also ordered both Halle and Olivier to refrain from discussing child custody issues with their son or making negative comments about each other or their significant others in front of him.

Last month, Halle claimed she spent $200,000 trying to “collaborate” with Olivier on co-parenting their son, in shocking court documents.

The Oscar winner married Martinez in 2013 – the same year they welcomed Maceo – and split in 2016. Their divorce was finalized seven years later in August 2023 – with the couple embroiled in a bitter custody battle ever since.

In documents obtained by American weekly Berry claims she spent more than $200,000 in legal fees, including a “voluntary” contribution of $80,000 to Martinez’s own legal fees.

She claimed that Martinez supports herself on her child support payments – so she has to “go to work.”

She claimed he had objected to paying for a home visit with their therapist during Berry’s time off before changing his mind.

She alleged that Martinez “delayed” court-ordered co-parenting therapy “despite several follow-ups.”

She wrote in the documents: “I have done everything possible to cooperate with Olivier, communicate with him and involve him in the decision-making process regarding our son. [Maceo] in an amicable manner.”

“Olivier has refused to co-parent and communicate with me in a child-centered manner; he was oppositional and uncompromising on all major issues related to Maceo.”

Text messages between the pair were also included in the documents, with Berry writing to Martinez: “I am very sorry that we disagree. I had better expectations for us. I always hoped that we would do better for Maceo and work together like we did before Van [Hunt- her partner].’

“It’s all gone to shit since then. We used to try to deal with maceos [sic] Okay, now you don’t even want to try and I tried Olivier… you know I did.’

“You just stay angry though and I’m not sure why. We need to let go of all this anger and do better. Maceo deserves that. I’m tired of being called a winch [sic]”I’m tired of fighting you and I’ve quit.”

‘If you want to perpetuate this negativity, that’s your responsibility, but I don’t want to hear about it… we have to ban it [sic] together now more than ever. However we face it, we must face it together and not fight. It’s just my opinion, but you make your choice.’

Martinez responded, “The only way to work together is to work together [sic] way. that is [sic] not working together. you [a]regarding [sic] playing dirty because you always haven’t posted maceos [sic] best interests first, but karma comes, don’t worry [sic].’

This comes two weeks after a new report offered more insight into her ongoing custody drama with ex Martinez.

Berry claimed Martinez is causing their son “prejudicial harm” with his latest motion to postpone an upcoming custody hearing.

Martinez, on the other hand, filed the week before that Berry is taking advantage of him by not giving him time to prepare, and “by trying to talk his way into an immediate hearing” to give him the “absolute minimum’.

The actress claims their son is struggling in school and is “falling behind,” adding that he has been diagnosed with ADHD and mild dyslexia.

She adds that Maceo’s father is “oblivious” to his difficulties, or “carelessly disregards them,” which she says proves he is unfit for custody.

The actress claims Martinez is delaying the custody hearing, which will impact a “ruling on interventions necessary for the parties’ struggling child.” She also claims that the actor is “trying to take more money from her.”

Martinez had previously stated that he needs an “expert” to testify on his behalf, which she called “nonsensical.”

“It would be unjust, and certainly harmful to Maceo, to continue the hearing of September 10, 2024 for 120 days on the basis that third parties are expected to testify or that Olivier is somehow unable to -identified experts must be retained,” the documents say. read.

Shortly after Berry’s filing, Martinez denied that the actress “refuses” to set a date that suits him.

He added that Berry has denied his request for help paying his legal fees, despite “making several million dollars right now.”

Halle also shares daughter Nahla, 16, with her ex-boyfriend Gabriel Aubry, 47.

Martinez met Halle on the set of Dark Tide, which was filming in South Africa in 2010, the same year she and Aubry announced their divorce.

The two made headlines in 2012 when they got into a fight with her ex Aubry over Thanksgiving. The model had dropped off daughter Nahla at Berry’s home in Los Angeles.

That’s when Martinez and Aubrey got into a verbal argument that quickly turned physical. Aubrey claimed the SWAT actor threatened to kill him. Both men had to be taken to hospital with their injuries.

Aubrey was arrested and served with a restraining order as a result of the incident.

The star was also previously married to David Justice between 1993 and 1997 and Eric Benét between 2001 and 2005.
