Halle Berry scores another win in child support battle with ex Gabriel Aubry

Halle Berry has won another victory in her simmering, decade-long confrontation with ex-lover Gabriel Aubry over child support, DailyMail.com can exclusively reveal.

Berry, 56, has been embroiled in costly custody battles for years with the fathers of her two children, Nahla Ariela Aubry, 15, and Maceo Robert Martinez, nine.

The Monster’s Ball actress was ordered to pay Gabriel Aubry $16,000 a month plus a $115,000 lump sum when the pair first met in LA Superior Court in 2014 – an amount she would later refer to as “extortion.” ‘.

In 2021, she managed to bring that figure down to $8,000 a month, but the Oscar winner had to pay him an additional 4.3 percent of any annual income she earned over $1.95 million.

Now, new filings obtained exclusively by DailyMail.com reveal that Berry — who reportedly earns $10 million per movie — has managed to narrow that figure down to $4.5 million.

That means the most she’ll have to hand over to her male baby daddy each year on top of the monthly payments will be about $110,000 a year.

Halle will continue to pay Gabriel 4.3% of any income she receives in excess of $1.95 million, as well as additional child support for Nahla, but any additional child support payments under this paragraph will not exceed $109,650 per year. , which is the difference between 4.3% of $1.95 million and $4.5 million,” the filing states.

“The parties agree that additional child support above $109,650 per year would exceed Nahla’s reasonable needs.”

The court’s victory comes as Berry is expected to see hefty payouts this year for two potentially lucrative film projects in the works.

She is currently filming action thriller, Our Man from Jersey, alongside Mark Wahlberg, while her Netflix sci-fi movie, The Mothership, is set for release later this year.

Assuming she made $10 million for each, she would have had to pay her ex an additional $860,000 of that income under the previous agreement.

It’s not all good news for Berry, though, as the amended pact, approved by Judge Michelle Kazadi on May 17, states that she still owes Aubry a portion of the $288,000 earnings for 2022, payable in monthly installments starting May 1. June.

The agreement, which will remain in effect until Nahla graduates from high school — or turns 19 if she’s still in school — raises hopes that the pair’s long-running custody feud is finally fizzling out.

The couple began dating in 2005 after Berry’s divorce from second husband Eric Benet, and announced their separation in 2010.

“She is and forever will be one of the most special and beautiful people I have ever known, and I am sure we will continue to have only love and respect for each other,” Aubry said after the breakup.

They insisted they “remain friends and devoted parents,” but soon became embroiled in legal proceedings after Berry attempted to move to France with Nahla to live with her now ex-husband Olivier Martinez.

The couple’s breakup initially seemed amicable, but eventually turned ugly after Berry attempted to move to France with Nahla to live with her new husband at the time.

Berry, who is currently in a relationship with singer and musician Van Hunt, claimed her daughter would be better protected due to strict privacy rules in France, but a judge blocked the move.

During a detention in the driveway of Halle’s home, Martinez and Aubry were involved in an arrest and were both treated for injuries.

She also tried to stop Aubry from having any contact with Nahla in 2012 after police investigated him for allegedly pushing his nanny through a door while holding the then-two-year-old girl.

The employee claimed she was left “psychologically traumatized,” but a judge denied her request for a restraining order, and Aubry was never charged in the altercation.

Berry has previously claimed that her child support payments should be cut by as much as 80 percent, accusing Aubry of “living off” the payments she sent him.

She also accused him of straightening and dyeing their daughter’s hair to make her look “paler.” A judge ruled that neither parent should alter Nahla’s natural hair texture or color.

“It was with regret that I came to the conclusion that I should seek the intervention of the court in these matters,” her lawsuit said.

“But until Gabriel recognizes the meaning of joint legal authority and how it is implemented, it seems the court will be my only recourse to protect Nahla’s interests.”

Berry was married to baseball player David Justice from 1993 to 1997 and to R&B singer Eric Benet from 2001 to 2003.

She married Martinez in 2013, but they announced in 2015 that they were separating. Their divorce and custody arrangements are still being worked out behind closed doors before a private judge.

In a thinly veiled critique of the men in her life, Berry shared a meme on Instagram in 2021 that read “women owe you nothing.”

The Catwoman actress – who did not name Aubry – opened up about her feelings about her huge child support bill, attacking the “outdated” rules used to determine the amount.

“It takes great strength every day (sic) to afford it. and besides, it’s wrong and it’s extortion!’ she wrote.

“I’ve been paying it for ten years now. I feel that if a woman or man has to pay for support, that is much more than the reasonable needs to SUPPORT the child, I think that is wrong!

“I understand that some parents (male or female) may need help, but I also feel that in this modern day and age both men and women have a responsibility to provide financially for their children and to work hard and give their all to do that.’

Berry added: ‘The way many laws are made, people are allowed to USE children to get money to live a lifestyle that not only they don’t deserve, but that goes way beyond the child’s reasonable needs and that is ‘THE WRONG’ and where I see the abuse.’
