Halle Berry has lost her bid to force her ex Olivier Martinez to undergo co-parenting therapy to resolve conflict surrounding their 10-year-old son.
The 57-year-old Oscar winner married Martinez, 58, in 2013, the same year they welcomed son Maceo, and separated in 2016. Their divorce was finalized seven years later in August 2023.
Berry alleged that Martinez tried to postpone their agreed-upon co-parenting therapy to “take the summer off” — but according to court documents obtained by Radar onlineA judge on Thursday denied the actress’ request, citing “the absence of compelling circumstances.”
The couple agreed to undergo therapy in May to “resolve disputes and conflicts between them in an effort to successfully raise their son together” — but according to court documents filed by TMZ Berry claims her ex decided last week to postpone the sessions until September so he could take the summer off – without consulting her or their therapist.
She claims he skipped the July sessions to travel to his native France and wants to cancel the August sessions because his brother is coming to visit.

The actress wanted a judge to force him to stick to the schedule set out in the agreement. She also says that since the therapy sessions are conducted via Zoom, Martinez can’t use travel as an excuse.
The star said the six joint sessions had to be completed by June 14.
According to Radar, Berry’s legal team claimed that Martinez’s absence from therapy was hindering their son’s “development and best interests.” Berry alleged that Martinez “constantly” dragged Maceo into their arguments, causing him to “turn against her.”
Martinez’s team responded by saying Berry was “constantly trying to extort the opponents.” [him] by using her wealth and the legal professionals at her disposal to force him into ‘submission.’
His attorney added that Maceo was in “no immediate danger” and argued that Berry decided to file the request when she “knew” Martinez would be traveling — and that Berry’s request did not qualify for an emergency order.

In May, it was announced that the former couple would seek the help of an adult and child psychiatrist to resolve their issues, according to court documents obtained by We weekly.

The physician determines “the manner, structure, duration of the session and frequency of the co-parenting therapy/coaching,” the documents say.
The duo would attend one solo session, after which they would attend at least six sessions together until June 14.
Berry’s boyfriend, Van Hunt, 54, could also be involved. Documents show the singer has not been “barred from participating in [their] Co-parenting therapy/coaching sessions.
Halle, who began dating Hunt in September 2020, finalized her divorce from Olivier in 2023.
She split from the Unfaithful actor seven years earlier, after just three years of marriage. They had drawn up a prenup, but there were still many problems.
A source said at the time We weekly: ‘Van has been a tremendous support to Halle throughout the entire process surrounding her divorce.’
“But at the same time, Halle is an incredibly intelligent woman and she can handle anything on her own. It’s obviously great to know that Van has her back and she feels like she’s finally found someone who treats her with the respect she deserves.”
Halle and Olivier had “some unresolved issues regarding custody and alimony” over their son, which led to the case being stayed in court, according to TMZ.
But in 2023, the exes agreed to a formal custody and alimony settlement.
The Oscar-winning star now has “joint legal and physical custody of Maceo,” the site claimed.
And she has to pay Olivier a whopping $8,000 a month, plus costs for Maceo’s health insurance, therapy and school.

Halle has custody of Maceo from Monday to Wednesday and Olivier from Wednesday to Friday, the site reports.
If schools are closed, changes will be implemented.
According to TMZ, the two will alternate custody of Maceo over the weekend.
She will also write a check for 4.3 percent of any earnings she receives above $2 million, the site said.
And on top of that there are a number of other costs.
Halle also has to pay for Maceo’s private school tuition and all of his other activities, such as his football expenses.
And Berry pays the bill for Maceo’s health and dental insurance and other expenses.
The beauty will also pay for any therapy her son may need.
Halle and her daughter Nahla, 16, whom she had with ex-boyfriend Gabriel Aubry, 47, are allowed to attend the family sessions, the site said.
Martinez met Halle on the set of Dark Tide, which filmed in South Africa in 2010. That same year, she and Aubry announced their split.
Things moved quickly for the glamorous couple, who confirmed their engagement in March 2012 and married a year later, on July 13, 2013, in France.
In October of that year, three months after their marriage, they welcomed a son, Maceo.
This is the third failed marriage for Halle, who was married twice before marrying Martinez. She never married Aubry, despite having a child with him.
In a joint statement, Halle and Martinez said, “It is with heavy hearts that we have made the decision to separate.
“We move forward with love and respect for one another and a shared focus on what is best for our son. We wish each other nothing but happiness in life and we hope that you will respect our privacy, and especially that of our children, as we navigate this difficult time.”
They had a falling out over his January 2015 incident at LAX, where Olivier hit airport worker Ronaldo Owens with a car seat and pushed him to the ground. Halle and their son were also present. In mid-October, a $5 million lawsuit was filed against Halle and Olivier for the attack.
This ‘aggravated their conflicts’, it was reported.
In addition to Maceo, Halle is also mother to daughter Nahla, 16, whom she had with ex-boyfriend Gabriel Aubry, 47. The couple split in 2010; seen in New York City in 2009
“They have a personality difference,” the site also claimed. “They’re just very, very different people. He’s very macho, and things just didn’t add up.”
The two made headlines in 2012 when they got into a fight with her ex Aubry during Thanksgiving, after the model dropped off daughter Nahla at Berry’s Los Angeles home.
That’s when Martinez and Aubrey got into a verbal altercation that quickly turned physical. Aubrey claimed the SWAT actor threatened to kill him. Both men were taken to the hospital for their injuries.
Aubrey was arrested and given a restraining order as a result of the incident.
Berry was previously married to David Justice (between 1993 and 1997) and to Eric Benét (between 2001 and 2005).
