Halle Berry is seeking sole custody of son Maceo, 10, amid bitter custody battle with ex Olivier Martinez

Halle Berry is taking her ex Olivier Martinez to court again over their child custody arrangement.

The 58-year-old Catwoman actress filed documents seeking sole custody over the education and medical decisions of their 10-year-old son Maceo.

In her filing, the Oscar winner and her attorneys allege that Martinez, 58, refuses to address the boy’s learning and behavioral issues, according to documents viewed by TMZ.

Berry claims the Unfaithful actor’s “turbulent behavior” and his push to prioritize their son’s soccer over school has caused Maceo to fall behind his classmates.

She also alleged that Martinez refused to give his son a private tutor because it would disrupt soccer practice.

The Moonfall actress also claims that her ex puts his own spin on his parents’ conflicts and that Maceo comes back angry and aggressive after spending extended time with his father.

Ultimately, she wants the judge to give her the authority to “make decisions about education and therapy.”

The former couple met in 2010 on the set of the film Dark Tide in South Africa.

At the time, the actress was in the midst of a nasty breakup with her ex-partner Gabriel Aubrey, with whom she had a 16-year-old daughter Nahla.

They married in 2013 and welcomed Maceo in 2014, but announced two years later that they were going their separate ways.

The main point of contention in the divorce was custody of their son, which was eventually settled in 2023. Court documents revealed that Martinez would receive $8,000 a month in alimony and 4.3 percent of the actress’s income above $2 million.

She would also pay for all of Maceo’s medical expenses, health insurance, tuition and extracurricular activities.

The agreement also stated that their son would undergo individual and family therapy.

This comes after Berry lost her bid earlier this month to force Martinez to undergo co-parenting therapy to resolve conflict surrounding their son.

Berry alleged that Martinez tried to postpone their agreed-upon co-parenting therapy to “take the summer off” — but according to court documents obtained by Radar onlinea judge denied the actress’ request, citing “the absence of compelling circumstances.”

The couple agreed to enter therapy in May to “resolve disputes and conflicts between them in order to successfully care for their son together.” But according to court documents obtained by TMZ, Berry claims her ex decided to postpone the sessions until September so he could take “summer break,” without discussing it with her or their therapist.

She claims he skipped the July sessions to travel to his native France and wants to cancel the August sessions because his brother is coming to visit.

The actress wanted a judge to force him to stick to the schedule set out in the agreement. She also says that since the therapy sessions are conducted via Zoom, Martinez can’t use travel as an excuse.

The star said the six joint sessions had to be completed by June 14.

According to Radar, Berry’s legal team claimed that Martinez’s absence from therapy was hindering their son’s “development and best interests.” Berry alleged that Martinez “constantly” dragged Maceo into their arguments, causing him to “turn against her.”

Martinez’s team responded by saying Berry was “constantly trying to extort the opponents.” [him] by using her wealth and the legal professionals at her disposal to force him into ‘submission.’

His attorney added that Maceo was in “no immediate danger” and argued that Berry decided to file the request when she “knew” Martinez would be traveling — and that Berry’s request did not qualify for an emergency order.
