Gang-rape horror as disabled girl, 12, ‘is sexually assaulted by at least eight classmates’ at Spanish school – but police will not take action because the boys were under 14

Eight boys who raped a disabled classmate at a Spanish school will not be investigated because they are under 14, the Public Prosecutor’s Office has said. The victim’s grandmother has described the horrific attack.

The attack on a 12-year-old disabled girl took place at a school in Peñaflor, Seville in May, according to Europe Press, who had access to the police report drawn up by the child’s family.

But since all the children involved in the horrific attack were born between 2011 and 2012 and are therefore 12 and 13 years old, the Youth Prosecution Service ‘cannot conduct any investigation’.

According to Spanish Juvenile Law, a rapist under the age of 14 is not liable under the law.

The case has therefore been transferred to the Child Protection Service.

But the Andalusian councillor for Social Inclusion, Youth, Families and Equality said at a press conference last week that the Andalusian government is in contact with the Public Prosecutor’s Office.

‘From now on we will set up all the mechanisms for the protection of the girl, of course to finance the origin of this behaviour and take the appropriate measures on that basis’.

According to the police document, the girl was “taken out of sight of students and teachers and taken to the girls’ restroom” during a recess, where the gang rape allegedly took place.

The girl’s grandmother, who is in shock and whose identity has not been released, told the Spanish television program ‘Y Ahora Sonsoles’ about the horrific incident.

“They grabbed my hands, spread my legs and had sex with me,” the girl is said to have told her grandmother, who replied, “No, honey, that’s not sex.”

Her grandmother also described the “hell” the girl went through in the days that followed, as she did not tell anyone about the attack for several days.

She didn’t want to go to school, didn’t want to eat, and didn’t want to sleep, her grandmother told another medium, Telemadrid.

She also repeatedly withdrew and threw herself on the ground, before finally opening up to her grandmother.

She was then taken to hospital for examination. The forensic medical team confirmed that the girl had been penetrated, the grandmother said.

Shocked Spaniards have taken to social media to express their concerns over the decision not to investigate the schoolboys further.

A user on X, formerly Twitter, said: “If legislation is not passed soon, these atrocities will continue, yet again at a school that washes its hands of this.”

Another said: ‘Please, what is happening to society? It’s clear that we are doing it wrong and treating children wrong.’

Lopez added that she is preparing a campaign for the Andalusian Institute for Women to raise awareness about minors’ consent.

Just last month, a Spanish court acquitted a man who raped a 12-year-old girl and impregnated her with twins, ruling that their relationship was simply part of Gypsy culture.
