According to the lawsuit, Katsioula-Beall, who was diagnosed with sarcoma in 2019, heard about a “stem cell treatment” that Phypers’ facility was performing on patients she hoped to try to treat her cancer.

Phypers reportedly boasted of a “98 percent success rate and was so confident in it” that he offered to refund half the cost of the treatment if it failed.

Perry says he and his wife paid $126,000 for the stem cell treatments from July through September 2023, but Katsioula-Beall got bad news in December of that year when she was reportedly told her tumors had grown by 25 percent.

Feeling that the treatment did not live up to Phypers’ hype, they wrote to him asking for a refund of $63,000.

Perry then accuses Phypers of “misconduct,” which he claims was “willful and intentional and that the intent was to deprive the plaintiff of property and/or legal rights or otherwise cause injury.”

“This despicable conduct subjected Plaintiff to cruel and unjust hardship in conscious disregard of his rights,” he added, asking for the case to be tried before a jury.

So far, Phypers has not commented on the lawsuit and reportedly has not yet filed a response to it in court.

It’s also unclear if his wellness center is even still in operation, as the location is listed as “permanently closed” on Google Maps and Yelp users have also reported that it is no longer active.

A website for the facility listed on its Instagram page also appears to be offline.
