Federal agents believe there is enough evidence to charge Hunter Biden with tax crimes and lying when buying a gun, according to an explosive report Thursday.

The Washington Post claims the investigation into the president’s son, which began in 2018, is now in the hands of US Attorney David Weiss, who was nominated by Donald Trump and would oversee any impeachment decision.

The investigation was sparked by Hunter Biden’s business deals with foreign countries while Father Joe was vice president, and the charges may include failure to pay income taxes, money laundering and violations of US tax laws.

A series of deals Hunter has struck with business magnates in China, Ukraine and Kazakhstan have been intensely investigated — and the president insists he knows nothing about them.

However, DailyMail.com received a voicemail in 2018 indicating that Joe had knowledge by saying, “I think you’re clear” following a New York Times article describing a link between Hunter and a Chinese oil tycoon.

Investigators also looked into whether he lied on paperwork to buy a gun in 2018 that his late brother Hallie’s wife later threw in the trash near a Delaware high school.

Hunter’s lawyers reacted furiously to Thursday’s Washington Post story by suggesting that leaking such information is a federal crime.

Hunter paid an outstanding tax debt in 2020 and acknowledged an investigation into what he called his “tax affairs.”

The case is overseen by a Weiss, the US attorney in Delaware, who was confirmed in 2018 and asked to stay on during the Biden administration. Biden and AG Merrick Garland have repeatedly said they would leave the case to professional prosecutors. The newspaper quoted anonymous people who were familiar with the case.

The weapon purchase issue relates to the standard paperwork for the purchase of a weapon. On the form, Hunter denied using illegal drugs or being addicted to drugs — statements that were undermined by his own behavior.

He has revealed in his own memoir that he was addicted to crack cocaine and struggled with drug and alcohol use.

Images found on his infamous laptop, which surfaced weeks before Election Day 2020 and contain data that experts who analyzed him verified for DailyMail.com, appear to show crack cocaine use.

Emails traced to the laptop also indicate a range of business activities in China and other locations. He also landed a lucrative board position at a Ukrainian energy company and did business in Kazakhstan and other distant countries.

The gun issue is the type that prosecutors sometimes charge and sometimes overlook. But according to DOJ figures quoted by the Post, there were 478 referrals for lying on firearms in the year of Hunter Biden’s purchase, with charges filed in 298 cases.

Rebecca Roiphe, Joseph Solomon Distinguished Professor of Law at New York Law School, told DailyMail.com that charges for lying on a federal form are rare, but if the crime is guilty, it carries a fine of $250,000 and a jail term of up to 10 years on.

“Prosecutors have a wide discretion as to whether or not to bring charges, even if they have sufficient evidence to prove that a person has violated federal criminal law,” she said.

“Some factors that a prosecutor might weigh include: the extent of the damage caused by the crime, the offender’s background or characteristics, and whether he has made any effort to repay or show signs of rehabilitation.” has shown, how similar cases have been handled in the past, and in general, whether such disbursement of funds would be in the public interest.

“I believe prosecutions for lying on gun purchase forms are relatively rare, but I don’t know the exact numbers. I can imagine that in general it would be very difficult to prove that someone lied on the form. In tax crimes, prosecutors tend to consider whether the individual has made an effort to repay taxes and whether it would be sufficient to take civil action.

“Federal prosecutors are considering this because they can get a reasonable resolution in some cases and deter others from committing tax crimes without spending resources on a criminal prosecution.

“In terms of penalties, the penalty for the tax offenses would vary depending on the specific offense charged. The penalty for lying on the federal form can be up to ten years in prison.”

White House Chief of Staff Ron Klain vouched for the president’s son in a TV interview in April.

“Of course the president is convinced that his son has not broken the law,” Klain said.

“But the most important thing, as I said, is that this is a matter to be decided by the Justice Department, through the legal process. It’s something that nobody in the White House has anything to do with.”

A 2018 voicemail from Hunter’s iPhone, revealed by DailyMail.com, appears to show Joe Biden reaching out to his son to discuss a New York Times article about his work at CEFC, despite the president’s denials that he once spoke to Hunter about his overseas business dealings.

“Hey buddy, it’s daddy. It’s 8:15 a.m. on Wednesday evening. If you get the chance, give me a call. Nothing urgent. I just wanted to talk to you,” Biden said on voicemail.

“I thought the article that appeared online, which will be printed in the Times tomorrow, was good. I think you are clear. And if you get the chance, call me, I love you.’

Hunter’s attorney, Chris Clark, began “leaking” in his own cutting response to the story.

“It is a federal offense for a federal agent to leak information about a Grand Jury investigation like this,” he said in a statement to the Post. “Every cop you cite as a source in your article has apparently committed such a crime. We expect the Justice Department to diligently investigate and prosecute such bad actors. ‘

“As appropriate and required by law, we believe that the prosecutors in this case are carefully and thoroughly weighing not only the evidence provided by agents, but also all other witnesses in this case, including witnesses to the defense. That is the job of the prosecutors. They should not be pressured, rushed or criticized for doing their job.’

With information in the public domain that investigators working on the case believe there is enough evidence to press charges, it could put pressure on the prosecutor overseeing the case to press charges .

Hunter’s business practices have become increasingly critical as media organizations continue to examine the content of material taken from Hunter’s laptop.

He and Biden’s brother James were reportedly paid $5 million by Chinese energy giant CEFC.

He even said that he was once offered a 2.8 carat diamond by CEFC Energy China magnate Ye Jianming.

Klain also told ABC’s George Stephanopoulos, “I just want to be very clear, these are actions by Hunter and his brother. It’s private business. They don’t involve the president. And they’re definitely something that nobody in the White House is involved in.”

The tax investigation started all the way back in the Obama administration, the New York Times reported, and expanded in 2018 to include possible criminal tax violations.
