The New England Patriots are being sued by a disgruntled man for allegedly causing up to $1 million in damages after lending a rare flag to the team’s Hall of Fame.

Per Yahoo SportsDaniel Vitale temporarily handed over a flag signed by Tom Brady during his second season in 2001.

The flag, which apparently hovered over Foxboro Stadium, the former home of the Pats, prior to the Miami Dolphins’ visit on December 22, 2001, was signed by Brady in the following months.

Both his signature and the flag itself were authenticated afterwards. The flag was loaned to the Patriots Hall of Fame last year after an agreement was reached between the parties.

In the lawsuit, seen by Yahoo Sports, Vitale alleges that museum curator, Kurt Evans, told him it would be displayed “using accepted professional library and museum techniques and standards.”

Vitale went to the flag in person last November – about five months after the loan – only to find he was out of sight.

A servant called Ken is said to have told Vitale that the flag was okay, but he said it in conversation; ‘I’ve been telling them for years to turn off the lights and the glass. It’s not the right stuff for this kind of display.’

In January, Vitale claimed he heard from Evans and informed him that the signature was “slightly faded.”

Photos released on Twitter, apparently by Vitale, show the stark contrast between the two supplied photos. According to the Twitter post, New England ‘threatens'[ed]…of [a] counter-trial.’

Brady won his first of seven Super Bowls during the 2001 season. The 45-year-old won six of his seven world championships in Foxborough.

The former 199th overall pick played in New England for two decades before moving to Tampa during free agency in 2020.
