Drew Barrymore’s stalker Chad Michael Busto is released from jail for the second time, as the hapless prosecutor said he couldn’t be held on bail because “it’s not a criminal offense.”

Busto has a lengthy criminal history, including an arrest in Santa Monica
Busto has a “long criminal history, including an arrest in Santa Monica.”
He also had numerous arrests in Georgia, Minnesota, Florida and Wisconsin for disorderly conduct, trespassing and other crimes, according to Santa Monica Daily Press.
According to multiple police reports, Busto’s criminal record dates from June 1999 to January 2022.
Among the crimes on his criminal record — spanning multiple states — are harassment, criminal trespass, resisting arrest, indecent exposure, disorderly conduct and theft, according to a report.
On August 21, Busto confronted Barrymore at an event at the 92nd Street Y during an interview with Reneé Rapp.
At the event, said the New York PostBusto shouted at Barrymore, “You know who I am! I have to see you sometime when you’re in New York!’
Busto was stopped from the stage by an on-site security guard while Rapp led Barrymore off the stage.
Two days later hE was taken into custody after entering the nearby $6 million luxury property in Sagaponeck.
Officials said he scoured the Hamptons neighborhood looking for Barrymore’s home. The 48-year-old actress was not in the home when he was arrested, sources said.
During an Aug. 25 hearing in Southampton Town Court, Judge Barbara Wilson released Busto — who was charged with misdemeanor fourth-degree stalking in the incident at her home — on the condition that he be fitted with a GPS tracker.
During the hearing, Busto told the court he was bankrupt and wanted to live in a shelter. He said he would appear at a hearing in Texas on September 3 in federal court.
Fourth-degree stalking is not a bail-eligible offense.
On Friday evening, Busto was arrested again after he went looking for British star Emma Watson, 33, during one of the fashion shows during New York Fashion Week. TMZ reported.
Busto allegedly entered a room at the Brooklyn Navy Yard at 63 Flushing Avenue around 7:40 p.m. and demanded to see the Harry Potter star, which was bustling with models and makeup artists.
He shouted at the onlookers as he pledged his love for the A-list celebrity.
‘I want to marry Emma Watson. Let me speak to Emma Watson,” he reportedly said. “Let me take a picture with Emma Watson.”
Management called police and Busto was taken into custody and charged with two counts of disorderly conduct, one count of trespassing and one count of criminal trespass in the third degree, according to a complaint obtained by DailyMail.com.
Several fashion shows were held at the Navy Yard on Friday, including famed designer Ralph Lauren.
Although it is unclear whether Watson was in the dressing room or at the fashion show during the ambush, the news channel reported.
The Brooklyn district attorney’s office said Busto was held overnight at central booking after his arrest and was arraigned in Brooklyn District Court this week before his release.
Busto is represented by Jessica Kovac, an attorney with Legal Aid Brooklyn. And the Brooklyn Justice Initiative is securing Busto’s supervised release.
When DailyMail.com contacted Kovac, she did not respond to our request for comment.
A representative from Suffolk County told DailyMail.com on Thursday that they were aware of Busto’s latest violation.
“Brooklyn is outside of our jurisdiction and we were unable to prosecute the suspect due to misdemeanor bail laws,” a representative said.
They confirmed that the warrant for his arrest was still in force.
Busto’s next court date is Oct. 10 at Kings County Criminal Court in Brooklyn for the Watson case. The New York Post reported.

Busto told DailyMail.com that he met Barrymore about ten years ago and hoped for a romance with her.
A source close to Barrymore said the actress was not shocked by the disturbing series of events.
