Elon Musk had secretly taken legal action for the parental rights of his three children with his ex-musician Grimes, a month before she sued the billionaire.

Last month, Musk filed a petition in Texas to take sole custody of X Æ A-Xii, 3, and Tau Techno Mechanicus, 1, and daughter Exa Dark Sideræl, also 1, according to the filing.

Musk claims in the filing that he has had “actual care, control and possession of each child since the birth of each child.”

He also noted in the filing that the care occurred in Texas, where he resides full-time for at least “six consecutive months.”

It comes after court documents revealed Grimes, real name Claire Boucher, filed a petition to establish a parental relationship in a California court on September 29.

The petition is a means of identifying a child’s legal parents if they are unmarried. The docket was public, but the files were sealed.

But it has now emerged that Tesla co-founder Musk put her in the post by filing a similar petition on September 7.

In the document, he accused the mother of his three children of moving to avoid the reach of Texas courts.

He stated that Grimes and their children lived with him in Texas between May and July of this year and mentioned that all three of his children lived in Travis County.

He added in his filings that he expected them to settle the custody case with a “written agreement,” but wants the Texas courts to intervene if necessary.

He also asked the courts to order the parties “to attend mediation prior to the final trial.”

Much of the court document has been redacted, identifying Musk and Grimes only by the initials R and E, respectively.

Musk’s lawyers argued that the family’s “health, safety or liberty” would be jeopardized by releasing identifying information.

The Canadian singer filed her petition just weeks after publicly begging Tesla co-founder Musk to let her see her son.

In a now-deleted post on the billionaire’s X platform, formerly Twitter, Grimes addressed Shivon Zilis, an executive at Musk’s Neuralink company and mother of his twins.

She said, “Tell Shivon to unblock me and tell Elon to let me see my son, or please respond to my lawyer.

‘I have never even been allowed to see a photo of these children until now, despite the situation completely tearing my family apart.’

Grimes’ petition included a “standard restraining order” that would prevent her children from being removed from California.

Her three children with the tech billionaire bring the number of children he has fathered to eleven.

He has twins Strider and Azure with Zilis, as well as five children with his first wife Justine Wilson. The couple’s firstborn, a son named Nevada, died at just 10 weeks old from cot death.
