An eco-zealot who was arrested after trying to confront Sir David Attenborough has now tried to call him as a witness in his upcoming trial.

Emma Smart, 45, has been arrested for disturbing the peace after she interrupted the legendary TV presenter’s meal at a Michelin-starred fish restaurant in Weymouth, Dorset.

It was alleged that Smart refused to leave the restaurant when asked and had to be dragged away by police.

The climate change protester has now appeared in court where she has filed a request to call Sir David as a key witness in her case.

It is alleged that Smart refused to leave the restaurant when asked and had to be dragged away by police.

But his application was rejected by the Weymouth magistrates.

District Judge Jonathan Layton said the request was “not relevant” and did not issue a subpoena.

He said: ‘I don’t see it being in the interest of justice to issue a witness subpoena.

I have made my decision, your request has been rejected.

It is about you rather than anything to do directly with Sir David Attenborough.

Smart has indicated that he has pleaded not guilty to one charge of breaching a section 35 dispersal order in that he stood by yelling at Sir David after being told to leave.

Smart said: “We don’t need another docu-series to show us that we are losing, some 150 species are going extinct around the world every day.”

A trial date was set for March next year at Poole Magistrates Court.
